RESOrTION NO. 21o
A PF-~OL~TION APPOINTING ENGINEER AND ATTORNEYS
SARATOGA AND COX A~ STORM DRAIN PROJECT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, this Council has determined to undertake proceedings
pursuant to appropriate assessment and assessment bond acts for the
acquisition and construction of public improvements in said City;
WHEREAS, the public interest and general welfare will be
served by appointing and employing engineers and attorneys for the
preparation and conduct of said proceedings and work in connection
with said improvements;
NOW, IT IS ORDERED, as follows:
1. That Creegan and D'Angelo, San Jose, California, be, and
they are hereby, appointed as Engineer of Work, and employed to do
and perform all engineering work necessary in and for said proceed-
ings, including all preliminary surveying, preparation of report,
plans, profiles, specifications, estimate of costs, diagram, assess
ment, setting grade stakes and supervision of work; that their
compensation be, and it is hereby fixed at a reasonable fee f.or all
of said engineering, said fee to be approved by the City Council
and assessed as an incidental expense of said proceedings; and tha~
Elmer M. D'Angelo, of said Creegan and D'Angelo, or his authorized
agent, be, and he is hereby, authorized and directed to make and
sign any certificate or document required to be made or signed by
the Engineer of Work.
2. That the Director of Public Works of said City is hereby
directed to examine and approve the engineering documents, and to
provide the inspection of the construction of said improvements,
and to accept said work when done to his satisfaction. The cost oJ
said inspection shall be assessed as an incidental expense of said
proceedings.
3- That the law firm of Wilson, Harzfeld, Jones ~ Morton,
San Mateo, California, be, and they are hereby, appointed and
employed to do and perform all legal services required in the con-
duct of said proceedings, including the preparation of all papers
not required to be prepared by the Engineer, examining and approvi~g
the engineering documents and advising the Engineer in the prepara-
tion of his work, advising all City officials on all matters relat-
ing thereto when called upon, and furnishing their legal opinion
on the validity of said proceedings and bonds, and that their
compensation be, and it is hereby, fixed at two per cent (~) of
the project cost, exclusive of subventions and incidental expenses
or Five Hundred Dollars ($500.00), whichever may be greater,
together with reasonable fees for services in acquiring easements
or in eminent domain or other suits if referred to them, to be
assessed as an incidental expense of said proceedings.
4. That the fees provided to be paid in paragraph 3 hereof
be paid from said assessments to be levied and bonds to be issued,
and not otherwise.
I hereby certify the foregoing to be a full, true and correct
copy of a resolution duly passed and adopted by the City Council oi
the City of Saratoga, California, at a meeting thereof held on the
