RESOLUTION NO. ~ 217 ....
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO SPECIAL ASSESS~ A~D ASSESSMENT
BOND ACTS FOR THE OONSTRUCTION OF IMPROVEMENTS
WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE
STREETS AND HIGHWAYS CODE
THEIMA AVENUE AREA ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, all of the owners of more than 60% in area of the
property subject to assessment therefor have signed and filed with.
the City Clerk of this City a written petition for undertaking
proceedings pursuant to special assessment and assessment bond
acts, and to assess the costs thereof upon the properties benefitec
by said. improvements, and waiving proceedings under Division 4 of
the Streets and Highways Code, for the following improvements:
The improving of Thelma Avenue from Saratoga-Sunnyvale
Road to Beaumont Avenue, Franklin Avenue for its Cntire
length, Hammona Avenue from Franklin Avenue to the north
line of Tract 388, Jims Way from Franklin Avenue to the
south line of Tract 627, Saratoga Vista Avenue for its
entire lengtlh, and Saratoga Vista Court from the east
line of Tract 537 to the west line of Tract 537, by
grading and the construction therein of Portland cement
concrete curbs and gutters, base pavement and wearing
surface, storm drain pipes, manholes, catch basins and
appurtenances as required, together with the construc-
tion of all work auxiliary to any of the above and
necessary to complete She same.
WHEREAS, the costs and expenses of said contemplated improve-
ments are to be chargeable upon an assessment district, the
exterior boundaries of which are the coterminous exterior bound. a-
ries of the composite and consolidated area shown on the map
thereof, on file in the office of the City Clerk of said City,
which indicates by a boundary line the extent of the territory'
included in the proposed district and shall govern for all details
as to the extent of the assessment district;
WHEREAS, the public interest and convenience will be set'red
by the taking of said proceedings;
NOW, IT IS HEREBY FOUND, DETERMINED and ORDERED that
all of the owners of more than 60% in area of the property subject
to assessment for said proposed improvements have filed with the
City Clerk of this City a written petition fop the construction of
improvements pursuant to appropriate special assessment and assess-
ment bond acts, without further compliance with the provisions of
Division ~ of the Streets and Highways Code.
IT IS ~vjRTHER FOUND, DETERMINED and ORDERED, that said pro-
ceedings for the construction of said improvements shall be had
pursuant to the Municipal Improvement Act of 1913 and the bonds
upon the unpaid assessments thereof shall be issued pursuant to th~
Improvement Bond Act of 1915.
IT IS FURTHER POUND:, DETERMXNED and ORDERED that the provi-
sions of Division 4 of the Streets and Highways Code be, and they
ape hereby, dispensed with.
I hereby certify that the foregoing is a full, true and
correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga, California., at s meeting thereof
held on the 16th day of December , 196 4 _, by the
following vote of the members thereof:
