RF~OLUTION NO. 225
A RESOLUTION AMENDING RESOLUTION NO. 211, ENTITLED
"A RESOLUTI0~ OF INTENTION T0. ACQUIRE AND CONSTRUCT
SARATOGA AND COX AVENUES STORM DRAIN AND SANITARY

RESOLVED, by the City Council of the City of Saratoga,
California, that Sections i and 9 of the Resolution cited in the
title, adopted November 4, 1964, are amended to read:
"l. That in its opinion the public interest and convenience
require and that it iS the intention of said Council to order the
following acquisitions and improvements, to-wit:
(a) The construction of reinforced concrete storm
drain pipe, manholes, catch basins and appurtenances from a point
in McFarland Avenue easterly in easements to be acquired heroin,
thence northerly to a point in Cox Avenue, thence in Cox Avenue
to Quito Road, together with similar facilities in Cox ~venue
from the point hereinabove mentioned westerly about 750 feet,
together with the acquisition of necessary rights of way and
easements and the construction of all work auxiliary to any of
the above and necessary to complete the same.
(b) The construction of sanitary sewer mains, wye
branches, laterals, manholes and appurtenances in Cox Avenue
from Quito Road westerly approximately 2040 feet to provide
sanitary sewerage service, together with all work auxiliary to
any of the above and necessary to complete the same.
'~9. That the City shall contribute to the project all
amounts heretofore collected as storm drainage fees from properties
to be assessed and County Sanitation District No. 4 of Santa Clara
County will contribute to the project that portion of the cost
thereof, including expenses incidental thereto, from Paseo Pres~da
easterly to Quito Road. Said contemplated acquisitions and im-
provements, in the opinion of the Council, are of more than local
or ordinary public benefit and said Council does hereby make the
balance of the costs and expenses thereof chargeable upon an
assessment district, which district said Council declares to be
the district benefited thereby~ the exterior boundaries of which
are described as the exterior boundaries of the composite ~nd
consolidated area of the parcels of property shown on the map
thereof entitled "Preliminary Storm Drain Layout~ Storm Drain for
Cox ~venue~ City of Saratoga, California~ on file in the office
of the City Clerk, which indicates by a boundary line the extent
of the territory included in the proposed district and which shall
govern for all details as to the extent of the assessment district
I hereby certify that the foregoing is a full~ true and
correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
held on the 3rd day of March , 1~65___, by the following
vote of the members thereof:
