HomeMy WebLinkAboutCity Council Resolution 309 RESOLUTION NO. 309 I~SOLUT!ON OF Tt~ CITY CO~ClL OF ~tE CITY OF SARATOCA AUTHORIZING FILING OF APPLICATION F~R GPa]T TO ACQUIRE OPEN SPACE LAND ~EKEAS; Title VII of ~he Housing Act of 1961 provides for the mskin~ of grants by the Housing and Home Finance Administrator to States and local public bodies to assist them in thc acquisition of permanent interests in land for open-space purposes where such acquisition is deemed essential to the proper IonS-range developments and welfare of urban areas in accordance with plans for the allocation of land to such purposes; and WHEREAS, the City of Saratoga, California~ desires to acquire fee title to certain land known as (1) Hakone Garden property comprising approximately 16 acres (2) Wildwood Pa~k, consisting of approximately 4 acres and (3) 5,85 acres of the Walter M. SeaSraves property adjacent to the Fruitvale Elementary School, which land, in accordance with the general plan adopted by the City Council~ is to be held and used as permenent open- space land for parks recreation and Civic Center purposes; and WHERFAtS, Title VI of the Clvil Rights Act of 1964, and the regulations of the Housing and Home Finance Agency effectuating that Title, provide that no person shall be discriminated s4~ainst because of race, color, or national origin in the use of land proposed to be acquired; and WHERFAS~ it is recognized that the contract for Federal grant will impose Certain obligations and responsibilities upon the applicant and wilt require amons other things (1) assurances that families and tndividua~s displaced as a result of the open-space land project will be relocated into decent, safe} and sanitaryhousing~ (2) compliance with Federal labor standards; and ~11EREAS, it iS estimated fi~at the total consideration to be paid for the acquisition of said ~nterests will be $305,000.00; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saratoga as follows: 1. T~at an application be made to the Housing and Home Finance Agency for a grant in an amount authorized by Title VII of the Housing Act of 1961, which amount is presently estimated to be $152,500.00 and that the City of Saratoga will pay the balance of the consideration for the acquisition of such interest and the total of all related costs from other funds available to it, 2. (a) That the City Administrator is hereby authorized and directed to execute and to file such application with the Housing and Home Finance Agency, to provide additional information and to furnish such documents as may be required by said Agency~ and to act as the authorized correspondent of the City of Saratoga. (b) That the Mayor of the City of Saratoga is authorized and directed to execute such contracts as are required by said Agency. 3o That the proposed acquisition is fn accordance with the general plan adopted by the City Council for the preservation of permanent open- space land, and that, should said grant be made, the City will retain said land for the use designated in said application and approved by the Housing and lIome Finance A~ency. ~. That the United States of America and the Housing and Home Finance Administrator be, and they are here%y, assured of full compliance by the City of Saratoga with regulations of the Housing and Home Finance Agency effectuating Title VI of the Civil Rights Act of 1964.
