HomeMy WebLinkAboutCity Council Resolution 310 RESOUJTION NO. 3 ~ 0 RESOLUTION OF TaB CITY COUNCIL OF THE CITY OF SARATOGA ADOPTING LAND ACQUI- SITION POLICY STATEMENT, AS REQUIRED By HOUSING AND HOME FINANCE AGENCY (a) The City of Saratoga is in the process of ac~Uiring and developing open-space land ~Oi' public park:purposes: (b) It is the intent~'of' .the City Council, in connection with such program, to apply for federal grants of money to aid the City of Saratoga in carrying out such a program| and, (c) The Housing and Urban Development Act of 1965 requires =hat a.n applicant for federal funds acquiring open-space land by the use of eminent domain proceedings be guided by a new Federal land Acquisition policy. IT IS THEREFORE RESOLVED as follows: In connection with all acquisitions of open~space land for the development of public parks, for which application for federal funds shall be made, the City Council will adhere to the Federal land Acquisi~ tion policy required by the Housing and Urban Development Act of 1965, as outlined in LETTER NO. 05-5, of the Housing and Home Finance Agency, dated September 27, 1965, and that, in particular, it will: 1. Make every reasonable effort to acquire each property by negotiated purchase before instituting eminent domain proceedings against the property. 2. Not require an7 o~ner co surrender the right to possession of his property until the City of Saratoga pays, or causes to be paid, =o =he owner (a) the agreed purchase price arrived at by negotiation, or (b) in any case where only the amount of the payment to the owner is in dispute, not less than seventy-five per cent (75%) of the appraised fair value as approved by the City of Saratoga and concurred in by HHFA. q 3. Not require any person lawfully occupying property to surrender possession without at least 90 days written notice from the City of Saratoga of the date on which possession will be required.
