RESOLUTION AUTHORIZING EMINENT
DOMAIN PROCEEDINGS
WHEREAS, The City of Saratoga deems it necessary to
acquire the hereinafter described real property for the 'public
uses of public buildings and grounds, which real property
is more particularly described and set forth on Exhibit "A"
attached hereto and incorporated herein by reference,
NOW, THEREFORE, the City Council of the City of
:Saratoga hereby resolves .=hat it finds and determines and
hereby declares as follows:
Section 1: The public interest and necessity require
the acquisition of the hereinafter described
real property, and a fee interest~in said property, for the
public use of public buildings and grounds and said property
is necessary therefor, and the public improvements are planned"
and located in the manner which will be most campatible with the
greatest public good and the least private injury.
Section 2: Pursuant to Article 1, Section 14 of the
California State Constitution, and Title VII,
Part 3 of the Code of Civil Procedure of said State, the City
of Saratoga is hereby authorized and empowered to take all
necessary steps to acquire a fee interest in the real property
mere particularly described in Exhibit '~" attached hereto, by
eminent domain, and to obtain immediate.possession of the same
upon the commencement of said proceedings, and the City Attorney
of the City of Sar~Dga is hereby authorized and directed to
commence such proceedings in the proper court having jurisdiction
thereof and to take all necessary steps to proceed to and to
conclude the condenmation of said property in accord herewith.
The above and foregoing Resolution was duly and regularly
passed and adopted at a meeting of the City Council of the City
of Saratoga, held on the ..... ~5th.. day of June ......... , 1966, by the
following vote, which vote constitutes not less than a two-thirds
vote of all the members of said City Council.

All that certain parcel of land situate in the City
of Saratoga, County of Santa Clara, State of California~
described as follows:
BEGINNING at an iron pipe driven in the center of

Fruitvale Avenue (formerly McCal Rd.) said pipe
being at the Northeast corner of that 26.06 acre tract
deed~dto Agnes Josephine Hourecan by Deed dated
October 6~ 1893 and recorded in Volume 163 of
deeds~ at Page A13~ in the Office of the County
Recorder of Santa Clara County~ California; running
the ~asterl bank of Wildcat Creek; thence South
0°02 West ~65.11 feet; thence running along a line
parallel to the North line of said 26.06 acre tract
East 1542.97 feet; thence North 0°18' East 165.11
feet to the POINT OF BEGINNING, containing 5.85
acres, more or less.
