RESOLUTION NO. 33~
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT
TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE
CONSTRUCTION OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER
DIVISION 4 OF THE STREETS AND HIGHWAYS CODE
SARATOGA HILL ROAD, ET AL. IMPROVEMENT PROJECT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, all of the owners of more than 60% in area of the
property subject to assessment therefor have signed and filed
with the City Clerk of this City a written petition fop undertak-
ing proceedings pursuant to special assessment and assessment
bond acts, and to assess the costs thereof upon the properties
benefited by said improvements, and waiving proceedings under
Division 4 of the Streets and Highways Code, for the following
acquisitions and improvements:
(a) The acquisition of property necessary for the opening
of s new road from Reid Lane northerly 545 feet, more or less,
along that certain easement for road purposes described in the
deed from the Estate of Alonzo Franklin Abernathy to L. L. Lewis,
dated April 2~, 1946, and recorded May 24, 1946, to Saratoga
Hills Road, a private road, as shown on the map of Tract No. 203,
Saratoga Hills, thence northwesterly, southwesterly and north- ~
westerly, along said Samtoga Hills Road, 2025 feet, more or less,,
to a point 36 feet, more or less, south of the north line of Lot
6 of said Tract No. 203, thence southerly 366 feet, more or less,
to a point on the west line of Lot ? of said Tract No. 203, 253
feet, more or less, northerly of the southwest corner of said
Lot ? and the improving thereof by clearing, grubbing, grading
and the removal of existing trees, shrubs and structures and
the construction therein of base, pavement, curbs, gutters, re-
taining walls where necessary, and surface and subsurface storm
drainage facilities where necessary, together with all appurte-
nances thereto.
(b) The acquisition of all lands and easements and the
performing of all work auxiliary to any of the above necessary
to complete the same.
WHEREAS, the costs and expenses of said contemplated acqui-
sitions and improvements ape to be chargeable upon an assessment
district, the exterior boundaries of which ape the coterminous
exterior boundaries of the composite and consolidated area shown
on the map thereof on file in the office of the City Clerk to
which reference is hereby made for further particulars;
WHEREAS, the public interest and convenience will be served
by the taking of said proceedings;
NOW, THERE~0RE, IT IS HEREBY FOUND, DETERMINED and ORDERED
that all of the owners of more than 60% in area of the property
subject to assessment for said proposed acquisitions and improve-
ments have filed with the City Clerk of this City a written
petition for the construction of improvements pursuant to sppro-
prlate special assessment and assessment bond acts, without
further compliance with the provisions of Division ~ of the Streets
and Highways Code.
IT IS F~T~ER FOUND, DETERMINED and ORDERED that said pro-
ceedings for the construction of said improvements shall be had
pursuant to the Municipal Improvement Act of 1913 and the bonds
upon the unpaid assessments thereof shall be issued pursuant to
the Improvement Bond Act of 1915.
IT IS PURTHER POUND, DETERMINED and ORDERED that the pro-
visions of Division 4 of the Streets and Highways Code be, and
they are hereby, dispensed with.
I hereby certify that the foregoing ~s a full, true and
correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga, Cslifornia~ at a meeting thereof
held on the 15~h day of June , 1966 ~ by the following
vote of the members thereof:
