RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN
INITIATED BY THE CITY .COUNCIL OF THE CITY OF SA~\TOGA
TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY
DESCRIBED HEREIN AND DESIGNATED "HAKONE GARDENS",
AND GIVING NOTICE OF TIME AND PLACE FOR ANY PROTESTS. THERETO.
The City Council of the City of Saratoga does hereby
resolve as follows:
Section 1: Pursuant to the provisions of the
Annexation of Uninhabited Territory Act
of 1939, and pursuant to Government Code Section. 35310 of
that Act, have been initiated, and are hereby
initiated, by the Council of the City of Saratoga, on its
own motion, to annex to the City of Saratoga all that un. in-
habited territory hereafter described and proposed to be
annexed; the City Council of the City of Saratoga desires
to annex said uninhabited territory to this City by v.~.rtue
of the fact that substantially all of said territory has
heretofore been purchased by this City and is presently
being used by this City as a public park of the City of
Saratoga, known as "Hakone Gardens".
Section 2: Said territory proposed to be annexed
to the City of Saratoga, hereby designated
'~Hakone Gardens" is more particularly described on Exhil:::,it
"A" attached hereto and incorporated h. erein by reference.
Section 3: The City Council 'hereby finds that the
Local Agency Formation. Committee of the
County of Santa Clara, in ~ession duly assembled on the
4th day of October, ].966, did 'pass and adopt Resolution
No. 66-168, wherein the ~roperty described on Exhibit "Al'
attached hereto is described as "Hakone Gardens and others",
approving said annexation.
Section 4: Wednesday, the 18th day of January
....... ].96 7, at the 'hou'rf'~f 8: 00
at the Council Chambers of the City of Sara. toga, City Hail,
Fruitvale Avenue, SaratOga, California, is hereby fi}~ect
as the time and place for the City Council to hear any
protests fi]..ed against said annexation, which protests
must be filed in accord with the law.
Section 5: The City Clerk of this City is hereby
authorized and directed to cause a copy
ozf this resolution to be published at ].east twice, but not
oftener than once a week, in a newspaper of genera.]. circu!a-
tion published in the City, and also in.. a newspaper of genera].
circulation published outside of the City but In' Santa Clara
County, said publi.cati.on to be complete at least twenty (20)
days prior to the date hereinabove set for the hearing;

The City Clerk is furt'her authorized and directed to
written notice of such proposed annexation to be mailed
to each person to whom land within the territory proposecl
to be annexed, is assessed ~n the last equalized Santa
Cl. ara County Assessment Roll, at the address shown on said.
Assessment Roll, or as is known to said Clerk, said not~.ce.
to be given not less than twenty (20) days before the

Section 6: The foregoing annexation, if completed,
will become effective on the date of

at a regular meeting held on the 7th day of December 1966
