RESOLUTION NO. 348
A RESOLUTION GRANTING CONSENT OF THE CITY COUNCIL OF THE
CITY OF SARATOGA TO SANITATION DISTRICT NO. 4 OF SANTA
CLARA C0UNTY TO UNDERTAKE PROCEEDINGS TO CONSTRUCT A
SANITARY SEWERAGE'PROJECT AND TO'PROVIDE THAT THE COST
SHALL BE ASSESSED ON THE DISTRICT BENEFITED UNDER APPRO-
PRIATE SPECIAL ASSESSMENT AND ASSESSMENT BOND PROCEEDINGS
SANITARY SEWERAGE PROJECT N0. 1966-2
UNIT NO. 1
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, the Board of Directors of County Sanitation District
No. 4 of Santa Clara county has filed with this Council a certified
copy of its Resolution requesting consent of this Council to under-
take proceedings pursuant to appropriate special assessment and
assessment bond acts for the construction of a sanitary sewerage
system and to assess the cost thereof on the lands described in
said Resolution;
WHEREAS, some of the proposed work and acquisitions are within
the limits of the City of Saratoga. over which this Council has Juris-
diction; and
WHEREAS, the public interest and general welfare will be served
by undertaking and completing said project;
NOW, THEREFORE, IT IS ORDERED, as follows:
!. That consent be, and the same is hereby, granted to said
County Sanitation D~strict No. 4 of Santa Clara County, to acquire
and construct said sanitary sewerage system as described in said
Resolution, to form said assessment district and to make such
changes and modifications therein as may be proper or advisablelin
the manner provided by law.
2. That consent be, and the same is hereby, granted to said .
District to open all such public streets as are required for the
installation of said sanitary sewerage system. All work pertaining
to said project shall be done under the direction of the District's
Engineer and to the satisfaction of the City Engineer of this City,
and in conformity with good engineering practice. Said District
~Engineer shall require of the contractor that all of the provisions
of the specifications are complied with by the contractor, to the
end that no greater amount of ditches are open at any time than is
necessary, that they shall be adequately lighted and barricaded,
and that they shalllbe promptly backfilled, and that the pavement
shall be restored with materials of like quality and character as
those~existing therein at the time of such work and to its former
condition and state of usefulness as nearly aslmay be. In this re-
gard, District shall first receive the written approval of the
Public Works Director that all backfill and paving complies with
City requirements prior to final payment to contractor, to which
District agrees by acceptance of the within consent~ this resolu-
tion being conditioned upon such agreement by District.
B. That the Public Works Director be~ and he is hereby~ autho-
rized and directed to carry out the provisions of this Resolution.
4. That the City Clerk be, and he is hereby, directed to file
with .the Secretary of said District s certified copy of this Resolu-
tion.
I hereby certify that the foregoing is a full, true and correct
copy of a Resolution duly passed and adopted by the City Council of
the City of Saratoga~ California~ at a meeting thereof held on the
7~h day of December , 1966, by the following vote of the
members thereof:
