HomeMy WebLinkAboutCity Council Resolution 354 RESOLUTION NO. 354 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA , CALIFORNIA, RELATING TO THE COLLECTION OF PROPERTY TAX COSTS AND PENALTIES FOR DELINQUENT TAXES OF GENERAL LAW CITIES IN THE COUNTY OF SANTA CLARA, CALIFORNIA. WHEREAS, the City of Saratoga, California has transferred the assessment and tax collection functions to Santa Clara County in order to effect a more economic and efficient service to the property owners of the City, and WHEREAS, a defect has existed in the law that delinquent penalties collected on overdue property taxes owing to general law cities when a county collects the taxes are paid into the countyfs general fund, and WHEREAS, under the same circumstances, where a chartered city is involved, such penalties are paid to such chartered city pursuant to Section 51554 of the Government Code, and WHEREAS, the City of Saratoga, California, believes this inequity should be corrected by the Board of Supervisors of Santa Clara County, and WHEREAS, Section 51521 of the Government Code which is now effective does permit a Board of Supervisors, as a matter of general county policy, to pay into a general law city treasury, the costs and penalty monies collected from delinquent taxes from property owners within that city. NOW, THEREFORE, BE tT RESOLVED , by this City Council of the City of Saratoga, California, that the Board of Supervisors adopt the policy of paying annually to the city treasurer the costs and penalties related to the non-payment of city taxes as provided in Section 51521 of the Government Code.
