A RESOLUTION AND ORDER ADOPTING ENGINEERtS REPORT,
CONFIRMING �'HE A�3�S�I�lE1+�'T' AN]7 ORDERING THE WURK
A1'�7 ACQUISITTONS
VII�LAGE FARKING DISTRICT N0. 1
RESOLVED, by the City Council of the City of Sarato�a, California,
that
WI�iEEREAS, on the �th day of May, 1966, safd Council adopted its
Resolution of In�ention No. 329, as subsequently amended, to acquix.e
and construct pub�.ic improvements in sa3.d C3ty and referred the pro-
posed acquisitions and i.mprovements to the Engineer of Work of said
City, he being the officer having charge and control of the construction
of 3.mprovements in and Por aaid City of the kind described in said
Resolution of Intention, as amended, and being a competent person ap-
pointed by said Council for that purpose;
WHEREAS, said Council thexeby directed said En�ineer of Work to
make and file with the City Clerk of �aid City a report in writing in
accordance witn and pursuant to the Municipal Improvemen� Act of 1g13;
WHEREAS, said report was duly made and filed w3th the City Clerk
of said City, whereupan said Clerk pr+�gented it to the Council f'or
consideration;
WHEREAS, said Council thereupon duly consfdered said report and
each and every part thereof and found that it contained all the matters
and things called f or by the provisi�ns of said Act, including (1 )
rnaps and descriptiona af lands and easements to be acquired; (2) plans
and specificat3.ons of the proposed improvements, �3) estimate of costs,
(�) diagram of district, and (�+) an assessment accarding to benefits,
all of whi.ch wa� done in the form and manner required by said Act;
WHEREAS, said Counail found that said report �nd each and every
part thereof was sufficient in every particu3ar and determined that it
should stand as the report far aIl subsequent proceedings under said Act,
whereupon aaid Council, pursuant to the requiremen�s of sa�d Act,
appainted Wednesda�, the 16th day of August, 1967, at �he hour of 5:00
�'clock P. M. of said day in the �ouncil Chambers, City Administration
Building, 337?7 ��uitvale Avenue, Saratoga, California, as the time
and place far hearing protests in relati�n ta said proposed acquisitions
and improvements, and directing the City Clerk of said City ta give
notice of said hearing as required by said Act;
i�HEREAS, it appears that no�ices of said hearing were duly and
regularly posted, mailed and published in the time, form and manner
required by said Act, as evidenced by �he affidavits on Pile with said
Clerk, whereupon said hearing wa� duly and regularly held at the time
and place �tated in said notice; and
WHEREAS, ----� persons interested, ob�ecting to said acqulsi-
tions and improvements, or �o the extent of the assessment district,
�� tr� the prop4sed assessment or diagram, flr to the maps and descrip-
tions, Qr �o th� grade� at which �aid work will be done, or �o the
Engineerts e�tima�e of the costs and expenses thereof, filed written
protests with the City C1erk of said Citq at or before the time set
for hearin�, and a11 persc�ns intere�ted deairing to be heard were
given an opportunity to be heard, and all matters and things pertaining
ta said acquisitions and improvements were fully heard and conaidered
by Said CouriCil, and were overruled al"ld said
Council haa acquired �jurisdictior� to order said acquisitions and
improvements and �he cc�nfirmatian of aaid diagram and assesament to
pay the cost� and exp+�r��ea thereof.
N�W, T�IEREFf�RE, �aid Council does hereby FIND, DETERMINE and
�1�DER, a� f ollows:
1 . That the owners of 4ne-half of the area to be assessed for
the cost a� the pro,�ect did not, at ar prior to the time f 3xed for
said hearing file written pro�ests againat the sai.d proposed acquisi-
tions and improver�ent� as a whale, or again�t th� said district or

the extent thereof to be asa�ssed for the costs and expenses of said
acquisitions and improvem�nts as a whole, or as to the Engineer � s
estimate of said costs and expenaes, or against the maps and descrip-
tians, or against the d�agram ar assesament to pay for the costs and
expenses there�f.
2. That the district benefited by said acquisitions a�d improve-
ments and to be assessed to pay the casts and expenses thereof, and

the exterior boundaries thereof are more particularly described in said
Resolutian of Intent3on, as amended, and made a part hereaf by ref-
erence thereto . That all public streets and hi��ways within said
assessment district in use �n the performance of a public function as
such shall be omi�ted from said district and from the levy and collec-
tion of the special taxes to be hereafter levied and collected to
cover the costs and expenaes af said acquisitions and improvem�nts.
3. That the plans and specifications for the proposed improv e-
ments, cantained in said report, be, and the� are hereby, f3nally
adopted and approved as the plans and specifications to which said work
shall be dane as called for in said Resolution of Intention, as amendede
� , That the Engineer' � estimate �f the itemized and total costs
and expense� of said acquisitions and im�rovements, and of the inci-
dental expen�ea in connec�ion therewith, contained in sa�d report, be,
and it is hereby, f inally adopted and approved as the Engineer 's �otal
and detailed estimate of the costs and expenses of safd acquisitions
and improvements .
5. That the maps and deacxiptions of the lands and easements to
be acqui�ed, as contained in said report, be, and the same are hereby,
finally approved and confirmed.
6. That the public interest and convenience require, and said
Council does hereby order the acquisitions and improvements to be made
as described in and in accordance with said Resolutian of Intention,
as amend�d, on file in 'the office of the �ity Clerk of said City, ref-

erence to which is hereby m�de for a more particular description of
said acquis�tions and impravements, and also for fuxther particulars
pursuant �o t�e provisions of said Municipal Improvement Act of 1913.
7. That the diagram showing the assessment district referred
to and described in said Resolution of Intention, as amended, and also
the boundaries and dimensions of the respect3ve subdivisions of land
within said district as the same existed at the time of the passage
of said Resolution oF Intention, as amended, each of which subdivisions
having been �iven a separate number upon said diagram, as contained in
said repor�, be, and it is hereby, finally approved and confirmed
as the diagram of the properties to be asseased to pay t�e costs and
expenaes of said acquisitions and improvements.
8. That the assessment of the total amount of the costs and
expensea of the prop�sed acquisitions and improvements u�on the sev-
eral subdivisions of land in said district in proportion to the esti-
ma�ed benefits ta be reaeived by said subdivisions, respectively, from
said acquisitions and improvements, and of the expenses incidental
�hereto, �ontained in said report, be, and the same is hereby, finally
approved and confirmed as the assessment to pay the coats and expenses
�f said acquisitions and improvements.
9. That said Engineerts report be, and the same is hereby,
f�nally adopted and approved as a whole .
10. That the City Clerk shall forthwith del3ver to �he Superin-
tendent of Streets t�e said assessment, together with said diagram
thereto attached and mad� a part thereof, as confirmed by this Council,
wit� his certif3cate of such confirmation thereto attached and of the
date thereo�; and that said S�perintendent of Streets shall record
said dia�ram and assessment in his office in a suitable baok to be kept
for tha� purpose, and append thereto his certificate oP the date of
such recordin�, and s�ch recardation shall �e and constitute the
assessment ro11 herein.

11 . That said Superintendent of Streets, upon the recording of
said diagram and a�ses�ment, �hall mai.l to each owner af real property
within the assesament di�trict at his last known address as the same
appears on the �ax rolls of the County of Santa Clara or on file in
the office of the City Clerk of said City, or to bath addresses if
said address ia not the same, or to the general delivery when no
address so appears, a staternent containing a designation by street
number or other description vf the property assessed sufficient to
enable the awner to identiPy the same, the amount of the assessment,
the time and place af payment thereof, the ePfect of failure �o pay
within such time, and a statement af the fact tha� bonds will be issued
on the unpaid assessments pursuant to the Improvement Bond Act of
1915, the last installment of which bonds shall mature not to exceed
twenty-£our (2�) years fram the second day of July next succeeding ten
months from their date.
12. That said Superintendent of Streets shall also give notice
by publishing a copy of a Notice to Pay Assessments by three successive
insertiona in the Saratoga News, a newspaper published in said City,
that said assessment ha� been recarded in his office, and that al1 sums
assessed thereon are due and payable immediately, and that the paymen�
of said aums is �o be made thirty (30) daya af�er the date of record3.ng
said asaessmen�, which date sha11 be stated in said notice, and of
the fact that bonds will be 3ssued upon the unpaid assessments as
above provided.
