HomeMy WebLinkAboutCity Council Resolution 379 RESOLUTION NO. 379 RESOLUTION OF INTENTION TO ABANDON PORTION OF COX AVENUE The City Council of the City of Saratoga does hereby resolve as follows: Section 1: Pursuant to Part 3 of Division 9 of the Streets..&:H~ghways Code of the State of California, the City Council of the City of Saratoga hereby declares its intention to order the vacation and aban- d.onment of that portion of Cox Avenue, at its intersection. with Saratoga Creek Drive and Saratoga Creek, more particu- larly described on Exhibit "A" attached hereto and herein by reference. Section 2: The 18 day of October 1967, ....... at t~ur of 8:00 6~cioCk P.MZ of said day, at the Council Chambers of the City Council, City Hall, Fruitvale Avenue, Saratoga, is hereby fixed as the time and place for hearing all persons interested in or objecting to the vacation and abandonment above set forth. Section 3: The City Council further declares that ' ' = it may require, as a condition to ordering abandonment of the above-described portion of public street, that said City may either retain an easement across all or any portion of said parcel for flood control purposes, and cause said easement to be conveyed to the Santa Clara County Flood Control and Water District, or in the alternative, may require the owner of the abutting property to convey such a.n easement over a portion of said property to said Flood Control District, and the City Council will hear evidence from all. persons concerned as to whether or not there is a public for the retention and/or securing of such flood control z',easement upon the abandonment of said portion of said street. The above and foregoing resolution was passed and adopted by the City Council of the City of Saratoga at a regular meeting held on the 20th day of September, 1967, by the following vote: AYES: Burry, Robbins, Tyler NOES: None ABSENT: Glennon, ltartman ATTEST: ,.,,'~ :"-.....3 EXHIBIT "A" A parcel of land described as follows: BEGINNING at a point which is N 22°42'42'' E 50.00 feet and ~ 67°17'18"w 30.00 feet from the intersection of the centerline of Saratoga Creek Drive and the centerline of Cox Avenue, as shown on the map of Tract No. 1764" as recorded on July 24, 1956, in Book 71 of ~4aps at Page 17, of Santa Clara County Records, .. THENCE S 22°42'42'' W along a line parallel to and 30.00 feet south- westerly of the centerline of said Saratoga Creek Drive, 19.06 fee~; THENCE along a curve to the right having a radius of 20.00 feet centeral angle of 79°03'56" for an arc length of 27.60 feet to a point on a curve.which is parallel to and 30.00 feet northerly of the centerline of Cox Avenue as said centerline is shown on the Record of Survey of Cox Avenue as recorded on June 23, 1965, in Book 196 of Maps at Page 15, Santa Clara County Records; THENCE along mid parallel curve which is a curve to the left having a radius of 1030.00 feet a central angle of 6~20'11'' for an arc length of 113.91 feet; THENCE N 5°26'27" E along a radial line of the last described-curve 107.59 feet to a point on the westerly boundary of Lot 19 of said Tract No. 1764; THENCE along the westerly and southerly boundaries of said Lot 19 the following courses and distances: S 16~28'E,17.84 feet; S 6~54' E, 48.85 feet; S 67~i7'I~8"E, 39.92 feet; S 22:42'42'' W, 10.00 feet; S 67~17'18"E, 40.00 feet; N 22~-42.'42" E, 10.00 feet; S.67°17'18'' E, 23.23 feet; THENCE along a curve to the left having a radius of 20.00 feet, a central angle of 90e, for an arc length of 31.42 feet to the POINT OF BEGINNING. Reference is hereby made to the official map of Cox Avenue on file in the Office of the City Clerk for further particulars as to location of the above-described portion of Cox Avenue.
