HomeMy WebLinkAboutCity Council Resolution 399-2 RESOLUTION NO. 399-2 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA CALLING A PUBLIC HEARING TO DETERMINE W]~THER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIREB THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON THE NORTH AND SOUTH SIDE OF VERDE VISTA LANE BETWEEN SARATOGA-SUNNYVALE ROAD AND TRACT 3942. BE IT RESOLVED by the Council of the City of Saratoga, as follows: WHEREAS, Ordinance No. 38.20 establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electrics communications or similar or associated service in any such district; and WHEREAS, it has been reconwnended that such underground utility district, hereinafter called District, be formed on the north and south side of Verde Vista Lane between Saratoga-Sunnyvale Road and Tract 3942. NOW, THEREFORE, BE IT RESOLVED as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of Saratoga on Sept. 4, 1968, at the hour of 8:00 o'clock, P. M. in the Council Chambers of the City Hall, 13777 Fruitvale Avenue, Saratoga, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated over- head structures and the underground installation of wires and facilities for supplying electric, co~unication, or similar associated service in the District. hereinabove discribed. 2. At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned at least ten (10) da~s prior to the date thereof. 4, The area proposed to be included in the District is shown upon that certain map entitled Saratoga Underground Utility District #2A, dated August 21, 1968, which is on file in the office of the City Clerk of the City of Saratoga.
