HomeMy WebLinkAboutCity Council Resolution 402 WJML: KJmh P-14-68-15 RESOLUTION NO o 402 A RESOLUTION AMENDING RESOLUTION N0. 393~ A RESOLUTION OF PRELIMINARY DETERMINATION UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE; RESOLUTION NOo 394, A RESOLUTION DIRECTING PREPARATION OF INVESTIGATION REPORT UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE; AND RESOLUTION NO. 396, A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS WEST VALLEY JOINT JUNIOR COLLEGE DISTRICT SARATOGA CAMPUS ASSESSMENT DISTRICT RESOLVED, by the City Council of the City of Saratoga, California, that 1. The description of the work set forth in each of the reso- lutions cited in the title, adopted by this Council on January 3, 1968, is amended to read as more particularly described in Exhibit hereto attached and incorporated herein by reference. 2. Section 12-A is added to Resolution of Intention No. 396, to read as follows: "12-A. Notice is further given that the City Council pro- poses to enter into an agreement, pursuant to Sections 10109, 10110 and 10111 of the Streets and Highways Code, with County Sanitation District Noo ~ of Santa Clara County which will pro- vide among other things for the supplying of plans and speclfi- tions for the proposed sanitary sewerage facilities, for the ownership upon the completion thereof by said District, and for the providing of service therefrom to the properties in the assessment district, in accordance with the rates, rules and regulations of the District as now or hereafter established, and that said agreement shall become effective after proceedings have been taken for the levy of the assessment and sale of bonds and funds are available to carry out its terms°" 3. That Section 13 of said Resolution No~ 396 is amend!ed to add the clause "and interior on-campus road" after the words "park- ing facilities" in the sixth line thereof. 4. That Section 18 of said Resolution No o 396 is hereby deleted and Section 19 is ~enumbered to 18. 5. That renumbered Section 18 of said Resolution No. 396, is hereby amended to read as follows: "18. If any excess shall be realized from the assessment, it shall be applied as a credit upon the assessment and any supplemental assessment." I hereby certify that the foregoing is a full, true and correct copy of Resolution duly passed and adopted by the City Council of the City of Saratoga, California, at a meeting thereof held on the 21st day of February , 1968, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Glennon, Tyler, Burry, Robbins NOES, Counc i lmen: None ABSENT, Councilmen: Hartman r ,, City E '~"~ the ~ Of Sa,'atoga APPRO D~ ~( ay ayor EXHIBIT "A" a) The acquisition of lands and easements necessary to widen the southerly one-half of Allendale Avenue and the easterly one-half of Fruitvale Avenue along the northerly and westerly boundaries, respectively, of the Saratoga Campus of the West Valley Joint Junior College District, and the improving thereof by clear- ing and grubbing, grading, subgrade preparation, base pavement and wearing surface, asphalt feathering, concrete curbs, gutters, traffic bars, striping, turn and control lanes~ storm drain pipe, catch basins~ manholes and appurtenances, landscaping, safety lighting, electroliers, traffic signals and signs. b) The improving 'of a parcel of land of the West Valley Joint Junior College District adjacent to Fruitvale Avenue as a public offstreet automobile parking lot by grading, removing trees, bushes and existing structures and the construction therein of base pave- ment, wearing surface, curbs, gutters, drainage facilities, lighting facilities, striping, landscaping and all auxiliary work necessary to complete the same as offstreet automobile parking facilities. c) The acquisition of the right of use of public storm drainage facilities by payment of acreage charges required therefor. d) The improving of an interior road on the property of the Saratoga Campus of the West Valley Joint Junior College District, by grading and the construction therein of base pavement and wearing surface, curbs, gutters, striping, traffic bars, signs, storm drain pipe, catch basins, manholes and appurtenances, and safety lighting. e) Underground electrical and telephone facilities as required to provide such service to the lands in the proposed assessment district. f) Water mains, valves, hydrants, services and appurte- nances as required for providing water service to said lands. g) Sanitary sewer mains, manholes, wye branches, laterals and appurtenances as required for providing sanitary sewerage service to said lands. h) The acquisition of all lands and easements and the construction of all work auxiliary to any of the above and necessary to complete the same.
