finds and dg~emines tha~ ~he public necessitys heal~h~ safety ~d ~elfare
require the r~oval of poless overhead rites ~d associated structuress and
t~ ~derground installati~ of rites and facilities for supplying electric,
c~ica~ion, or similar or associated services on Allendale Avenue from F~i~vale
Aven~ ~o Por~os Drive and ~ Eas~ side of Fruitvale Avenue ~een Saratoga
Aven~ ~d San Hercos Road as sho~ on ~p of Saratoga Underground U~ili~y
District ~1 dated April 3, 1968; and furtMrs but ~i~hou~ limiting ~he foregcing~
tha~ s~h undergrounding is in ~he public inCeres~ because i~ rill avoid or
elimina~e an unusually hea~ concen~ration of overhead dis~ributi~ facilities;
~d pursuant to Chapter 15 of the Saratoga City Codes such described area is
hereby established as Saratoga Underground Utility District No. 1.
RESOLVED, FURTHER, that the following shall not be exceptions in said
Underground Utility District No. 1:
Those facilities more particularly described in subsections (d), and (f) of
Section 15-6, Chapter 15 of the Saratoga City Code. Subsections as follows:
(d) Poles, overhead wires and associated overhead structures used for the
transmission of electric energy at nominal voltages in excess of 34,500
volts.
(f) Antennae, associated equipment and supporting structures, used by a
utility for furnishing communication services.
RESOLVED, FURTHER, that all poles, overhead wires and associated overhead
structurs shall be removed and underground installations made in said underground
utility district within the following times:
a. Underground installation by utility companies and property owners
and reconnections not later than July 15, 1968;
b. Removal of poles, overhead wires and other associated overhead
structures not later than July 25, 1968;
RESOLVED, FURTHER, that the City Clerk, within ten (10) days after the
adoption of this resolution, shall mail a copy hereof and a copy of ordinance
No. 38.20 to affected property owners as such are shown on the last equalized
roll and to the affected utilities.
Adopted this lot day of May, 1968, by the City Council of the City of Saratoga
by the following vote:
AYES: Councilmen Glennon, Tyler, Hartman, Robbins, Smith
NOES: None
ABSENT: None
