HomeMy WebLinkAboutCity Council Resolution 440 RESOLUTION NO. 440 ~STABLISH!NG S~T~A ~E~ROUND. !IT!LXTY DISTRICT NO. ~,A BE IT RESOLVED by the Council of the City of Saratoga as follows: WHEREAS, by Resolution No, 3'99-2, a public hearing was called for Wednesday, September 4, 1968, at the hour of 8:00 P. M. in the Council Chambers in the City Hall, Saratoga, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communications or similar or associated service on Verde Vista Lane from Highway 85 to/4~'feet West as shown on Map of Saratoga Underground Utility District #2-A dated August 21, 19.68; and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, TItEREFORE, Be it resolved that the Council of the City of Saratoga hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground tnstllation of wires and facilities for supplying electric, communication, or similar or associated service, on Verde Vista Lane 'from Highway 85 to ............ feet West as sho~n on Map of Saratoga Underground Utility District #2-A dated August 21s 19681 and furthers but without limiting the foregoing, that such undergrounding is in the public interest because it will avoid or eliminate an unusually heavy concentration of overhead distribution facilities; and pursuant to Chapter 15 of the Saratoga City Code, such discribed area is hereby established as Saratoga Underground Utility District No. 2-A. RESOLVED, FURTHER, that the following shall not be exceptions in said Underground Utility District No. 2-A. Those facilities more particularly described in subsections (d), and (f) of Section 15-6, Chapter 15 of the Saratoga City Code. Subsections as follows: (d) Poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 voltS. (f) Antennae, associated equipment and supporting structures, used by a utility for furnishing coamnunication services. RESOLVED, FURTHERs that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within thefollowfn~ times: a. Underground installation by utility companies and property o~ners and reconnections not later than August 1, 1969| b. Removal of poles, overhead wires and other associated overhead structures not later than August 30, 19691 RESOLVED, FURTHERs that the City C Cork, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of ordinance No1 38-20 to affected property o~ners as such are shorn on the last equalized roll and to the affected utilities.
