HomeMy WebLinkAboutCity Council Resolution 451-B RESOLUTION NO. 451-B A RESOLUTION OF THE CITY OF SARATOGA APPROVING BUDGET FOR THE VILLAGE PARKING MAiNTENANCE DISTRICT NO. 1 AND FIXING TAX RATE FOR THE FISCAL YEAR 1970-71. RESOLVED, by the City Council of the City of Saratoga, Santa Clara County, California, that WHEREAS, this Council has heretofore ordered the formation of Village Parking Maintenance District No. 1 pursuant to Resolution of Intention No. 329, adopted by the Council of the City of Saratoga on May 4, 1966, as amended; WHEREAS, said maintenance district was formed for the purpose of maintaining and operating off-street motor vehicle parking facilities in and for said maintenance district; WHEREAS, a budget for the fiscal year 1970-71 for said maintenance district has been heretofore submitted to this Council; and WHEREAS, the public interest, convenience, and necessity will be served thereby; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows: 1. That the budget for Village Parking Maintenance District No. 1, heretofore submitted, be, and it is hereby approved, and it is hereby determined that all of the costs of maintenance and operation within said maintenance district shall be borne wholly by said maintenance district. 2. Tbat the minimum amount of money required for the purposes of maintaining and operating the parking facilities in and for said maintenance district during the fiscal year ending June 30, 1971, to cover the costs and expenses of maintaining said improvements, will be in the sum of $2,900.00 and it is hereby estimated that said sum is the minimum amount of money required by said district for such purposes during said ensuing fiscal year. 3. That the rate of taxation for the purpose of raising said monies for the maintenance and operation of the parking facilities in and for said main- tenance district is hereby fixed at 1.25 for each $100.00 of taxable real property in said maintenance district. 4. The Village Parking Maintenance District No. 1 was formed pursuant to Chapter 26, comprising Sections 5820 through 5856 of Division 7 of the Streets and Highways Code. The budget for maintenance for the fiscal year 1970-71, and this resolution, are appzoved and adopted pursuant to Sections 5830 and 5831 of ~aid Streets and Highways Code. The above and foregoing resolution was duly and regularly introduced and adopted by the City Council of the City of Saratoga at a regular meeting held on the 19nh day of August, 1970, by the following vote: AYES: Councilmen Robbins, Sanders, Dwyer ,ridges NOES: N one MAYOR ATTEST: CLERK 8/24/70 Taxation file: Government Code Section 36936.1 provides that the ordinance or resolution which fixes the amount of revenue required to be raised by taxation as well as the ordinance or resolution which sets the rate of taxes must be published at least once within 15 days after its passage, in a newspaper of general circulation published and circulated in the city. In other words, whether it is done by an ordinance or whether it is done by a resolution, both have to be published as if they were an ordinance. Next, the Village Par~Maintenance District #1 was created under the Improvement Act of 1911. Section 5831 of the Streets & Highways Code under that Improvement Act provides that the special assessment tax is to be levied in the same manner as the general tax levy. This means that although it appears quite proper to both fix the amount of money to be required and also to fix the rate of taxation at least for that 'parking district by the same resolution, that resolution must be pub- lished just like an ordinance by virtue of the general procedural requirements in the Government Code.
