HomeMy WebLinkAboutCity Council Resolution 455 RESOLUTION NO. 455 RESOLUTION APPROVING APPLICATION OF THE PROVISIONS OF SECTION 23 OF THE UNITED STATES HOUSING ACT OF 1937, AS AMENDED, TO THE CITY OF SARATOGA WI{EREAS, under the provisions of Section 23 of the United States Housin~ Act of 1937, as amended, the Housing Assistance Administration is authorized to provide financial assistance to local public housing agencies in providing low-rent housing by leasing dwelling units in existing privately-o~ned structures; and WHEREAS, said Section 23 provides that the provisions thereof shall not apply to any locality unless the governing body of the locality has by resolution approved the application of such provisions to such locality; NOWs THEREFOREs BE IT RESOLVED BY TKE COUNCIL OF SARATOGA AS FOLLOWS: The application of the provisions of Section 23 of the United States Housing Act of 1937, as amended, to the City of Saratoga is hereby approved subject to the following conditions: 1. That the authority charged with responsibility for local administration of the program establish a two-year Saratoga residence preference for applicants. 2. That the City Council of Saratoga shall approve any and all income schedules adopted by the local administrative authority for purposes of determining eligibility under the low-rent housing program, 3. That all rental units operated under the program shall meet and comply with all local city codes and health standards which are in existence at the time the initial lease is executed, 4. That on the average, the amounts paid by the local administrative authority for leased premises shall be consistent with local lease-rental rates and not infla- tionsty in trend. 5, That in the event a tenan[ of a lease-rental housing is a welfare recipient, rental payments shall not be less than ~elfare housing allowance. 6. That the County Housing Authority shall establish and maintain an effective cooperative program with the City for the rehabilitation of demolition of such structures at the time of vacations by persons participating in the lease-rental program, The purpose of the cooperative program rill be to subject dilapidated or substandard structures to the Ctty*s h~alth and safety inspections and procedures when vacated by persons participating in the rent-subsidy program in order that such structures will not be noccupied until they comply with all local city codes, 7. That the number of units operated in Saratoga by the local administrative authority shall be limited to a figure mutua!1y agreed upon from time to time by said authority and the City Council of Saratoga. 8. That monthly occupancy reports shall be submitted to the City Council of Saratoga by the locat administrative authority showing the status of the program and its degree of effectiveness in meeting toe-income and elderly citizens' co~nunity housing needs. 9. That the City Council or the Council*s designated authority shall approve all waivers, relating ~o the number of tenants to be concentrated in any one area of the City, which are provided for in the provisions of Section 23 of the U. S. Bousing Act of 1937 as sinended.
