RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
CALLING A PUBLIC HFJYRING TO DETERMINE WHETHER PUBLIC
NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIP~S THE FORMA-
TION OF AN UNDERGROUND UTILITY DISTRICT ON TIlE CIVIC CENTER
PIIOPERTY ON FRUITVALE AVENUE~ BE~IEEN WILDCAT CREEK, FRUIT-
VALE AVENUE AND THE REDWOOD SC~IOOL PROPERTY.
BE IT RESOLVED by the Councilof the City of Saratoga, as follows:
whereas, ordinance No. 38.20 establishes a procedure for the creation of
underground utility districts and requires as the initial step in such Drocedure
the holding of a public hearing to ascertain ~hether public necessity, t~ealth,
safety, or welfare requires the removal of poles, overhead wires and associated
overhead structures and the underground installation of wires and facilities
for supplying electric, communication, or similar or associated service in any
such district; and
W~tEREAS, it has been recommended that such underground utility district,
hereinafter called District, be formed on the Civic Center property on Fruitvale
Avenue, between Wildcat Creek, Fruitvale Avenue and the Red~4ood School Droperty;
NOW, T}~REFORE, BE IT RESOLVED as follows:
1. NOTICE IS HEREBY GIVEN that a Dublic hearing will be held by the Council
of the City of Saratoga on April 16, 1969, at the hour of 8:00 o'clock, P. Mo in
the Council Chambers of the City Hall, 13777 Fruitvale Avenue, ~arato~a, Calif-
ornia, to ascertain whether the public necessity, health, safety, or welfare
requires the removal of poles, overhead ~ires and associated overhead structures
and the underground installation of wires and facilities for supDl~ing electric,
communication, or similar associated service in the District heroinabove descr~bed.
2. At such hearing all persons intmrested shall be given an opportunity to
be heard. Said hearing may be continued from time to time as may be determined
by the City Council.
3. The City Clerk shall notify all affected property o~mers as sho~m onthe
last equalized assessment roll and utilities concerned at least ten (10) days
prior to the date thereof.
4. The area porposed to be included in the District is sho~m upon. that
certain mmp entitled Saratoga Underground Utility District No, 3, dated
April 2. 1969, which is on file in the office of the City Clerk of the City of
Saratoga.
