HomeMy WebLinkAboutCity Council Resolution 480 WJML:PDA:gmb 1/18/68 20c RESOLUTION NO. 480 A RESOLUTION OF INTENTION TO FORM THE ARROYO-SARATOGA PARK MAINTENANCE DISTRICT NO. 1 RESOLVED, by the City Council of the City of Saratoga, Santa Clara County, California, that l~ In its opinion the public interest and convenience re- quire, and that it is the intention of said Council to order the formation of a maintenance district in a portion of said City, pursuant to Chapter 26, Part 3, Division 7 of the Streets and High- ways Code, the Improvement Act of 1911, to be designated "Arroyo- Saratoga Park Maintenance District No~ l"~ by which name it shall hereafter be referred to in all subsequent proceedings, including proceedings for the levy and collection of taxes~ 2. Said Maintenance District, and the boundaries thereof, benefited and to be assessed for the maintenance and operation of the improvements hereinafter referred toe are situate in the City of Saratoga, County of Santa Clara, State of California, and are more particularly described in Exhibit "A" attached hereto and by reference incorporated hereino 3o It is ordered that the expenses of maintaining and oper- ating all walkways, crosswalks~ steps, safety zones., platforms, seats, statuary, fountains, decorative walls, signs, benches, parks and parkways; drainage facilities; poles~ posts, wires~ pipes, conduits, tunnels, lamps and other suitable or necessary appliances for the purposes of lighting streets~ places or public ways~ water mains and sprinkler systems~ and ornamental planting including lawns, shrubs and trees, now existing or hereafter to be constructed in or for said Maintenance District~ and of bene- fit to said Maintenance District but not of benefit to the City of Saratoga~ as a whole, including the cost of necessary repairs, replacements, water~ fuel~ power~ gas~ electric current~ care~ supervision and any and all other items necessary for the proper maintenance and operation thereof~ shall be assessed wholly upon the real property within said Maintenance District above des- cribed~ which District said Council hereby determines will be the District benefited by the maintenance and operation of said im- provements, and that the amounts so assessed are to be levied and collected in the same manner and by the same officers as taxes for City purposes are levied and collected~ 4o The Saratoga News~ a newspaper published and circulated in said City~ is hereby designated as the newspaper in which this Resolution of Intention shall be published~ and the City Clerk of said City is hereby directed to cause this Resolution of In- tention to be published by two insertions in the manner and form provided by law~ the first publication being at least fifteen (15) days before the date of hearing° 5~ The City Clerk shall cause to be conspicuously posted along all the open streets and avenues within said proposed Main- tenance District~ and in front of all property liable to be assessed at not more than 300 feet in distance apart, but not less than three in all in each street so posted in said Mainten- ance District, ~.otices of the passage of this Resolution of In- tention in the manner and form required by the Improvement Act of 1911~ and amendments thereto~ said posting to be completed at least fifteen (15) days before the date of hearing~ 6o The City Clerk is hereby directed to cause to be mailed notice of the adoption of this Resolution~ postage prepaid, to all persons specified~ in the form and manner provided by law~ said mailing to be completed at least fifteen (15) days before the date of hearing° 7o NOTICE IS HEREBY GIVEN that Wednesday~ the ~t!~ day of ~une 1969, at the hour of 8:00 o'clock PoMo in the regular meet- ing place of said Council, City council c~amb~rs ~.t ! 13777 Fruitvale Avenue, Saratoga, California, are hereby fixed as the time and place when and where any and all persons having any objections to the formation of said Arroyo-Saratoga Park Main- tenance District No. l, or to the extent of said Maintenance Dis- trict, or both, my appear before said Council and show cause why the formation of said proposed Maintenance District should not be carried out in accordance with this Resolution of Intention.
