A RESOLUTION ACCEPTING COMPLETION AND
DIRECTING ENGINEER TO FILE NOTICE OF
ACCEPTANCE OF COMPLETION
WEST VALLEY JOINT JUNIOR COLLEGE DISTRICT
SARATOGA CAMPUS ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, the Engineer of Work of said City has filed with
the Clerk of said City, his Engineer's Certificate as to the com-
pletion of all of the work provided to be done under and pursuant
to the contract between said City and Ao J. Raisch Paving Co.,
dated April 22, 1968; and
WHEREAS, it appears to the satisfaction of this Council
that said work under said contract has been fully completed and
done as provided in said contract and the plans and specifications
therein referred to, except that the Council feels the need for
additional facilities as hereinafter provided in paragraph 2
hereof;
NOW, THEREFORE, IT IS ORDERED, as follows~
lo That' acceptance of completion of said work be, and it is
hereby, made and ordered~
2. That the City Engineer is directed to execute and file
for record with the County Recorder of the County of Santa Clara,
notice of acceptance of completion thereof~ as required by law;
provided, however, that said notice shall not be recorded until
such time as the City is provided with an enforceable corporate
surety bond in form to be approved by the City Attorney in the
penal amount of $20,000 guaranteeing that any defects in asphalt
surfacing in those portions of Allendale AvenUe and Fruitvale
Avenue, which are identified by dark shaded areas on the map~
marked Exhibit "A" hereto attached and incorporated herein by
reference, which defects result from any faulty materials or
workmanship incorporated into said work which may appear and are
discovered within the period of three years from the date of
adoption of this resolution~ are promptly remedied°
I hereby certify that the foregoing is a full, true and
correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga~ California~ at a meeting thereof
held on the 4th day of June _, 1969~ by the follow-
ing vote of the members thereof:
