RESOLUTION ON APPEAL FROM PLANNING COMMISSION DECISION
WHEREAS, the City of Saratoga Planning Commission has heretofore
denied the application of Sunset Associates, 12230 Saratoga-Sunnyvale Road,
San Jose, California for a variance to allow a freestanding 39-square foot
sign in lieu of the permitted 37! square foot building sign, which action
has been appealed to, and a hearing on appeal held thereon byethe Saratoga
City Council, in accord with Ordinance NS-3 of said City, and
WHEREAS, a hearing de novo was not held on said action, and
WHEREAS, it appears that there was substantial evidence presented to
the Planning Commission upon which it based its decision, and it appears
just and equitable that said decision be affirmed,
NOW, THEREFORE be it resolved:
1. The decision of the Planning Commission is hereby af£irmed.
PASSED AND ADOPTED by the City Council of the City of Saratoga this
17th day of September, 1969, by the following role call vote:
AYES: Councilman Dwyer, Sanders, Smith, Tyler
NOES: None
ABSENT: Councilman Robbins
