HomeMy WebLinkAboutCity Council Resolution 510 RESOLUTION NO. 510 A RESOLUTION OF THE CITY COUNCIL OF SARATOGA ESTABLISHING A GRIEVANCE POLICY IN RECOGNITION OF THE RIGHT OF EACH EMPLOYEE TO APPEAL THE ACTIONS OF THOSE FOR WHOM HE WORKS AND PROVIDING A PROCEDURE FOR ACHIEVING FAIR AND INDIVIDUAL TREATMENT FOR EVERY EMPLOYEE WHEREAS, the City Council of Saratoga respects the rights of each employee and believes in his personal dignity; and WHEREAS, the City Council recognizes the right of each individual to appeal the actions of those for whom he works; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SARATOGA that the following procedure be adopted for resolving individual grievances: (1.~)' An employee who has a job-related problem or grievance which he believes. the City can he~p-himsotvel'shoutd discuss it with his immediate supervisor or department head. If the problem or grievance is not resolved to the employee's satisfaction by the end of the next working day, he may bring the matter to the attention of the City Manager who, within a period of two working days, will discuss it with the employee, ascertain all relevant information and inform the employee of his decision. (1.3) Should the employee still not be satisfied, he may appeal to the City Council Management Committee which will review the matter and resolve it by final decision that will be binding and conclusive on all concerned. The Management Committee will exert all reasonable efforts to complete its review and inform the employee of its decision within one week after receipt of his appeal. BE IT FURTHER RESOLVED THAT: (2.1) In order to aesure maximum objectivity, it is essential that the investigator make every deliberate effort to view the sit- uation from the employee's perspective and give full consider- ation to all factors which may justify the employee's position. (2.2) The employee is entitled to a speedy resolution of his problem. The facts of the situation should be analyzed and a clear-cut decision made as soon as possible. (2.3) This policy is a key element in maintaining high standards of human relations in the City. Each department head has the re- sponsibility for maintaining an effective employee-manager re- lationship, and for taking whatever actions are necessary to solve the problems of his employees. (2.4) The use of the Grievance Policy, in and of itself, will not in any way prejudice the employee's position in the City, either at the time of his complaint, or in the future. (2.5) The purpose of this resolution is to insure harmonious relations between employees, and between and among supervisors, department heads and employees, but in no way is it to be construed as limit- ing the ability of the appropriate persons in supervisorial cap- acities to exercise their right to dismiss, to employ or not to employ persons. The within resolution is an expression of existing policy of the City of Saratoga, and is subject to modification and change by the City Council from time to time. Nothing herein contained shall be construed as creating or establishing any of the provisions of this resolution as terms of any contract of employment between any officer or employee and the City. The above and foregoing resolution was duly and regularly introduced and passed by the City Council of the City of Saratoga at a regular meeting held on the 19th day of November , 1969 by the following vote; AYES: Councilmen Tyler, Dwyer, Robbins, Smit~, Sanders NOES: None ABSENT: None MAYOR ATTEST: ./~ CITY
