HomeMy WebLinkAboutCity Council Resolution 512 WJML: PDA: ~p 10/30/69 30c RESOLUTION NO. 51.2 A RESOLUTION OF INTENTION TO FORM THE ~9~NOR DRIVE PARK MAINTENANCE DISTRICT RESOLVED, by the City Council of the City of Saratoga, Santa Clara County, California, that lo In its opinion the public interest and convenience require, and that it is the intention of said Council to order the formation of a maintenance district in a portion of said City~ pursuant to Chapter 26, Part 3, Division 7 of the Streets and Highways Code, the Improvement Act of 1911, to be designated "Manor Drive Park Maintenance District" by which name it shall hereafter be referred to in all subsequent proceedings, including proceedings for the levy and collection Of taxes. 2. Said Maintenance District, and the boundaries thereof, benefited and to be assessed for the maintenance and operation of the improvements hereinafter referred to, are situate in the City of Saratoga, County of Santa Clara, State of California~ and are more particularly described in Exhibit "A" attached hereto and by reference incorporated herein. 3. It is ordered that the expenses of maintaining and operating all decorative walls and parkways; posts, wires, pipes, conduits, lamps, and other suitable and necessary appliances for the purposes of lighting streets~ places or public ways; water mains and sprinkler systems; and ornamental planting including lawns, shrubs and trees, now existing or hereafter to be constructed in or for said Mainten- ance District, and of benefit to said Maintenance District but not of benefit to the City of Saratoga, as a whole,'!~ncluding the cost of necessary repairs, replacements, water, fuel, power, gas, electric current, care, supervision and any and all other items necessary for the proper maintenance and operation thereof, shall be assessed wholly upon the real property within said Maintenance District above described, which District said Council hereby determines will be the District benefited by the maintenance and operation of said improvements, and that the amounts so assessed are to be levied and collected in the same manner and by the same officers as taxes for City purposes are levied and collected. 4. The SaratogalNews, a newspaper published and circulated in said City, is hereby designated as the newspaper in which this Resolution of Intention shall be published~ and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published by two insertions in the manner and form provided by law, the first publication being at least ten (lO) days before the date of hearing. 5o The City Clerk shall cause to be conspicuously posted along all the open streets and avenues within said proposed Maintenance District, and in front of all property liable to be assessed at not more than 300 feet in distance apart~ but no~ less than three in all in each strset so posted in said Maintenance District, notices of the passage of this Resolution of Intention in the manner and form required by the Improvement Act of 1911, and amendments thereto~ said posting to be completed at least ten (lO) days before the date of hearing. 6o The City Clerk is hereby directed to cause to be mailed notice of the adoption of this Resolution, postage prepaid, to all persons specified, in the form and manner provided by law, said mailing to be completed at least fifteen (15) days before the date of hearing. 7. NOTICE IS HEREBY GIVEN that Wednesday, the 3rd day of December~ 1969, at the hour of 8:00 o'clock P.M. in the regular meeting place of said Council, City Administration Building, 13777 Fruitvale Avenue, Saratoga, California, are hereby fixed as the time and place when and where any and all persons having any obNections to the formation of said Manor Drive Park Maintenance District, or to the extent of said Maintenance District, or both, may appear before said Council and show cause why bhe formation of said proposed Maintenance District should not be carried out in accordance with this Resolution of Intention. ******** I hereby certify that the foregoing is a full, true and correct copy of Resolution duly passed and adopted by the City Council of the City of Saratoga, California, at a meeting thereof held on the 5th day of November, 1969, by the following vote of the members thereof.
