HomeMy WebLinkAboutCity Council Resolution 514 RESOLUTION NO. 514 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA OPPOSING SALE OF UNSOLD SWAMP AND OVERFLOWED LANDS TO PRIVATE PARTIES BY THE STATE LANDS COMMISSION WHEREAS, the State Lands Courmission recently considered selling a parcel of "unsold swamp and overflowed lands" of about 3 2 acres located in the Sunnyvale area to the Leslie Salt Company; and WHEREAS, the State Legislature has created the Bay Conservation and Development Commission and has given them jurisdiction over the salt pond areas; and WHEREAS, the Bay Conservation and development Commission has carried out the legislative mandate to prepare a plan for the use of the Bay and the Baylands and has been further charged by the legislature to identify lands recommended for public acquisition; and WHEREAS, the several cities and the County of Santa Clara have individually and jointly, through the Planning Policy Committee, declared the Bay and its associated Baylands to be an irreplaceable natural resource; and WHEREAS~ several of the cities and the County have been or are in the process of acquiring Baylands for public use, BE IT, THEREFORE, RESOLVED THAT the State Lands Commission not sell or transfer title to any of the various submerged lands and the unsold swamp and overflowed lands in Santa Clara County or any other county fronting on the Bay, but rather retain title for the State; and, in the event lands are to be disposed of, the State should first offer such land to public agencies. BE IT FURTHER RESOLVED THAT although the sale of the parcel of unsold swamp and overflowed land at an attractive price may seem an immediate ad- vantage to the State, the sale at an inflated and unrealistic price may set a dangerous precedent adversely affecting future State and local public acquisitions. The above and foregoing resolution was duly and regularly introduced and passed by the City Council of the City of Saratoga at a regular meeting held on the 19th day of November, 1969 by the following vote: AYES: Councilmen Tyler, Dwyer, Robbins, Smith, Sanders NOES: None ABSENT: None ATTEST: // i!::::::::...,;::ZZi .......... y/ CITY CLERK
