RESOLUTION N0.
A RESOLUTION DIRECTING PAYMENT OF COST OF ACQUISITION
OFRIGHTS OF SERVICE AND USE IN SANITARY SEWERAGE
FACILITIES AND AUTHORIZING APPLICATION OF
SURPLUS AS A CREDIT TO ASSESSMENT
WEST VALLEY JOINT JUNIOR COLLEGE DISTRICT
SARATOGA CAMPUS ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, said Council, pursuant to Resolution of Intention
No. 396, adopted January 3, 1968, provided for the acquisition and
construction of certain public improvements and for the levy of
assessments to pay the costs thereof, all as therein particularly
described;
WHEREAS, assessments in the total sum of $650,000 were levi~d~
and bonds were issued to represent the unpaid assessments;
WHEREAS, the West Valley Joint Junior College District~ owner
of the property assessed in said proceedings~ has advanced directly
to County Sanitation District No. 4 of Santa Clara County, the
cost of acquisition of rights of service and use in existing sani-
%ary sewerage facilities of said district, by payment of connection
fees in the amount of $5,287.50, and has acquired the right to
reimbursement of said sum from the proceeds of assessmen%s and
sale of assessment bonds, if available, by assignment from said
sanitation district;
WHEREAS~ it appears that upon completion of said project and
the payment of all costs of construction, acquisition, and of all
incidental expenses in connection therewith, including said sum of
$5,287.50, a balance of $1,543.55 remains in the Construction Fund
for said project;
WHEREAS, this Council desires that said balance remaining in
said construction fund be applied in accordance with law as herein-
after provided;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED~
as follows:
1. The amount of $5,287.50 shall be paid from the Construc-
tion Fund to the West Valley Joint Junior College District, in
reimbursement of its advance of the cost of acquisition of rights
of service and use in the sanitation facilities of County Sanita-
tion District No. 4 and pursuant to an assignment by said sanita-
tion district to said junior college district of the right to
receive said funds.
2. That the balance remaining in the Construction Fund after
said payment, being $1,543.55, is surplus.
3. That in view of the fact that one installment of the
principal of said assessment has been paid in cash and the amount
of said payment is in excess of the amount of said surplus, the
credit shall be returned in cash to West Valley Joint Junior Colleges,
District, being the person paying the same.

correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
held onl the 4th day of March ., 1970, by the following
vote of the members thereof:
