The City Council of the City of Saratoga hereby resolves as follows:
WHEREAS, the City of Saratoga is under ever-increasing urbanizing pressure
with consequent demands for its remaining open space by residential, commercial
and industrial interesEs; and
WHEREAS, the City realizes that, today, permanent preservation of adequate
open space is a vital factor in maintaining a healthy economic balance for the
City as well as for conserving its natural resources, protecting its natural
beauty and providing active and passive recreation facilities for both adults
and children; and
WHEREAS, the City is interested in acquiring tracts of open space via do-
nation for the purposes of recreation, conservation, open space preservation and
tax stabilization to protect and enhance the total environment of the city; and
WHEREAS, the City is interested in p~omoting the donation of lands within
such designated open space areas, or any other lands in the City that would ful-
fill the same purposes as determined by the Parks and Recreation Commission and
Planning Commission; and
WHEREAS, the City is eager to encourage landowners to donate land in fee or
less than fee for permanent open space preservation by making its favorable atti-
tude and good intentions for land preservation clear, including indication of the
kind of tax and other benefits available to landowners;
NOW, THEREFORE BE IT RESOLVED that the City of Saratoga express its intention
to accept gifts of land in fee or less than fee (i.e. conservation or scenic ease-
ments) with reasonable restrictions as to their future use and management to pro-
tect their preservation as open space, so long as the restrictions or covenants

are consistent with the Ci y s open space policies; and
BE IT FURTHER RESOLVED that the Parks and Recreation Commission working with
the City Council and other City agencies will give all possible assistance and
information to landowners who are contemplating such action.
Passed and adopted by the City Council of the City of Saratoga at a regular
meeting held on the.. 19th day of AugUst , 1970, by the followinv vote:
