HomeMy WebLinkAboutCity Council Resolution 399-5 RESOLUTION NO. 399-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON BIG BASIN WAY, BETWEEN FIFTH STREET AND BLANEY PLAZA WHEREAS, Chapter 15 of the Saratoga City Code establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called THE VILLAGE DISTRICT, be formed on Big Basin Way between Fifth Street and Blaney Plaza, NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of Saratoga on Weane§day, August 18, 1971, at the hour of 8:00 o'clock, P.M. in the Council Chambers of the City Hall, 13777 Fruitvale Avenue, Saratoga, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar associated service in the District hereinabove described. 2. At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. -1- 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned at least ten (10) days prior to the date hereof. 4. The area proposed to be included in the District is shown on that certain map entitled "Saratoga Village Proposed Underground District dated the 19th day of February, 1971, which is on file in the office of the City Clerk of the City of Saratoga. The above and foregoing resolution was passed and adopted by the City Council of the City of Saratoga at a regular meeting thereof held on the 4th day of August, 1971, by the following vote: AYES: Councilmen Robbins, Smith, Dwyer, Bridges NOES: None ABSENT: Sanders ~ ~ ~ Mayor ATTEST: -2-
