W~AS, the Saratoga City Council has by Resolution established a procedure
for initiating, filing, and processing requests for establishment of 'agricultural
preserves and
~E~, Charles Maridon, owner of Assessors'Parcel Number 503-017-023 an~ John F.
and Minnie Torre owners of Assesgors' Parcel Number 503-107-021 have each made written
application to the City Council of the City of Saratoga for the establishment of an
agricultural preserve pursuant to the California Land Conservation Act of 1965, and
~E~, the Saratoga Planning Department has submitted a report to the City
Council on the Maridon and Torre applications, which report recommends preservation
of the Maridon and Torre lands for agricultural uses through the establishment of the
requested agricultural preserve, and
~E~AS, the City Council has held a public hearing on the Maridon and Torre
applications which hearing was duly noticed as required by law,
NOW, THEIrFORE, the City Council of the City of Saratoga hereby resolves as
follows:
The land area encompassing that portion of the Maridon property within the City
of Saratoga designated as Assessor's Parcel Number 503-017-023 and containing
17.662 Acres and that portion of the Torre Property within the City of Saratoga
designated as Assessor's Parcel Npmber 503-017-021 and containing 12.44 Acres is
hereby established as an agricultural preserve.
That the City Council finds the following uses compatible within the agricultural
preserve:
1. The drying, packing or other processing of an agricultural commodity usually
performed on the premises where it is produced but not including slaughter
houses, fertilizer yards, bone yards or plants for the reduction of animal
or vegetable matter.
2. The packing of not to exceed 40 buckets of cherries per day for no more than
two weeks each year on the Maridon property. This packing m~y be done on the
Maridon property only at the beginning and the end of Ehe cherry harvest.
3. Structures necessary rod incidental to the agricultural use of the land.
4. ~e holding of nonproducing land for future agricultural use.
5. ~e maintenance of land in its natural state for the purpose of preserving
open space for recreation or plant or animal preserves.
6.Single f~ily dwellings incidental to the agricultural use of the land for
the residence of the owner, and the family of the owner.
Single f~ily dwellings incidental to the agricultural use of the land for
the residence of the lessee of the land and the family of the lessee.
Owner or lessee shal~-be construed to include:
(a) stockholders in family corporations
(b) beneficiaries of family trusts and estates ~
(c) owners of undivided partial interests in the fee
(d) joint tenants
7.Dwellings for persons employed by owner or lessee in the agricultural use of
the 1 and.
8. The construction and maintenance of a stand or shelter for the sale of 0
agricultural commodities produced on the land.
9. The erection, construction, alteration or maintenance of gas, electric, water
or communication utility facilities in =ompliance with the city's underground
utility ordinance No. NS-3,20.
10, Fishing
11. Public or private riding or hiking trails.
12, Riding academy, stables and the boarding of horses or other livestock but
not including an animal hospital or kennel,
That the hereinabove listed compatible uses will be the only uses permitted
within said agricultural preserve except that the City Council may upon request of
owners, successors or assigns add additional uses to the list of compatible uses.
That the Mayor is authorized to execute Land Conservation contracts with
' Charles Maridon and John F. and Minnie Torre their successors Or assigns.
The above and foregoing resolution was duly and regularly passed and adopted
by the City Council of the City of Saratoga at a regular meeting thereof, held on the
20th day of january, 1971, by the following vote:

WITHIN THE CITY OF SARATOGA
WHEREAS, the Saratoga City Council has by Resolution established a procedure
