RESOLUTION N0. 588
A RESOLUTION AUTHORIZING AND DIRECTING
PROCEEDINGS IN MANDATE
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, on the ._4]~_._day of A!,~,,~ ...... , 1971, the City
Council of the City of Saratoga duly adopted a resolution calling
for bids on sale of $2,000,000 of special assessment bonds autho-
rized in proceedings conducted pursuant to Resolution of Intention
No. 565, adopted March 1?, 1971, wherein the City Clerk of this
City was directed to call for bids for the sale of said bonds;
WHEREAS, said resolution calling for bids directed the City
Clerk to cause copies of notice of sale of bonds to be mailed to
the various banks and bond houses interested in the purchase of
such bonds at leas~ ten (lO) days before the date of sale of said
bonds;
WHEREAS, the City Clerk, upon being advised of the legal
issues involved in the issuance of said bonds, and on advice of
Counsel, has refused to cause said notice of sale,'in form pre-
pared and presented by Bond Counsel as provided in said resolution,
to be mailed in accordance with the directlye of said resolution;
NOW, THEREFORE, IT IS ORDERED, that Wilson, Jones, Morton &
Lynch, Bond Counsel of the City, is hereby authorized and directed
to initiate and prosecute to conclusion a Judicial action in man-
date in the Court of Appeal of the State of California to compel
the City Clerk to do his legal duty, namely, to cause notice of
sale of said bonds to be mailed in accordance with the directives
of said resolution.

correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting
