HomeMy WebLinkAboutCity Council Resolution 599 RESOLUTION NO. 599 A RESOLUTION AUTHORIZING EXECUTION OF A BOUNDARY LINE AGREEMENT BETWEEN THE CITY OF SARATOGA AND THE CITY OF CAMPBELL, CALIFORNIA WHEREAS, there has been submitted to the City Council of the City of Saratoga, a proposed agreement with the City of Campbell for the establishment of boundaries; and WHEREAS, the City Council is fully advised of the contents thereof, and finds the agreement is for the best interest of the people of the City of Saratoga. WHEREAS, said agreement is attached hereto, marked Exhibit "A", and made a part hereof. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saratoga that the Mayor be and he is hereby authorized to execute the said agreement on behalf of the City of Saratoga. The above and foregoing resolution was regularly introduced and thereafter passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 19th day of January, 1972~ by the following vote: AYES: Councilmen Robbins, Smith, Dwyer, Bridges, Kraus NOES: None ABSENT: None MAYOR ATTEST: ,: .... . I. .~ ~ -.. ~.~..,,,~. .~.~~~././'~' EXHIBIT "A" BOUNDARY LINE BET~IEN THE CITY OF CAMPBELL AND THE CITY OF SARATOGA BEGINNING at the point of intersection of the southerly line of Pollard Road with the realigned center line of the Arroyo San Toads Aquino, said point bearing South 75° 20' 00" West 35.00 feet and South 14° 49' 05" East 20.00 feet from the southwesterly corner of Tract No. 4133, a map of which is filed in Book 226 of Maps at Page 20 in the office of the County Recorder, County of Santa Clara, State of Califorhia; THENCE, in a northerly direction along said realigned center line of the Arroyo San Toads Aquino through the following courses: North 14° 49' 05" West 97.47 feet along a tangent curve having a radius of 200.00'feet, concave easterly, through a central angle of 44° 42' 34" for an arc length of 156.07 feet; thence North 29c 53' 29" East 384.96 feet; thence along a tangent curve to the left having a radius of 200.00 feet through a central angle of 21° 42' 47" for an arc length of 75.79 feet; thence North 08° 10' 42'' East 289.43 feet; thence on a tangent curve to the right having a radius of 400.00 feet through a central angle of 15° 14' 10" for an arc length of 106.37 feet; thence North 23° 24' 52" East 95.33 feet; thence on a tangent curve to the left having a radius of 300.00 feet through a central angle of 04° 57' 07" for an arc length of 25.93 feet; thence North 18° 27' 45" East 75.28 feet; thence on a tangent curve to the l'eft having a radius of 475.00 feet through a central angle of 29° 02' 56" for an arc length of 240.82 feet; thence North 10° 35' 11" West 133.91 feet to the intersection thereof with the westerly prolongation of the southerly line of Lot 43 of Tract 3535 as said Lot 43 and Tract 3535 are shown upon that certain map filed in Book 206 of Maps at Pages 39 and 40 in said office of said County Recorder; THENCE, South 74° 07' 00" West 6.05 feet along said prolongation to a point on the existing center line of the Arroyo San Tomas Aquino; THENCE, in a northerly direction along skid existing center line through the following courses: North 5° 29' 15" West 320.55 feet; thence North 52° 04' 45" East 66.78 feet; thence North 1° 41'45" West 134.11 feet; thence North 23° 50' 45" West 86.39 feet; thence North 26° 14' 15" East 61.68 feet to the point of intersection of said existing center line with the southerly line of the Southern Pacific Railroad Company right of way as shown upon said map of Tract No. 3535. Huff City Manager City of Saratoga 13777 Fruitvale Avenue Saratoga, CA 95070 Dear Mr. Huff: This is to acknowledge receipt of both your letter of January 17 and your Council's Resolution No. 600 urging continuation of the Urban Extension Program. Your position was was brought to the attention of the Commission at their meeting January 20, along with similar expressions received from many other city and county agencies. As you are no doubt aware, at their December 15 meeting the Commission heard testimony from a delegation of city and county representatives concerning the Department's proposal to terminate the Urban Extension Program; and in response to the request of this delegation the Commission deferred action on the matter to allow time for staff discussions between the State and cities and counties to explore possible alternatives. A report on these discussions, together with recommendations, was expected at the Commission's meeting January 20, however, at that time the Department advised that although the joint meetings had enabled them to develop a position they had not had an opportunity to explore it in-depth with the city and county representatives with whom they had been working. The Commission, therefore, deferred action on the disposition of the UE Program to its next meeting, February 17; and in recognition of the disruptive consequences of these recent activities to the orderly filing of Urban Extension Project proposals, they also passed a minute order extending the date for filing requests for 1973-74 fiscal year Urban Extension Projects to on or before March 1, 1972. We are informed that the State Highway Engineer is planning to disseminate information, concerning the final decision of the Commission on the Urban Extension Program, to all cities and counties immediately following the February meeting.
