HomeMy WebLinkAboutCity Council Resolution 623 RESOLUTION NO. 623 RESOLUTION ORDERING VACATION AND ABANDONMENT OF PORTIO.N OF A SLOPE EASEMENT The City Council of the City of Saratoga does hereby resolve as follows: SECTION I: Pursuant to Part 3 of Division 9 of the Streets and Highways Code of the State of California, a hearing was held on this Council's proposal to vacate and aban- don the hereinafter referred to street, at the hour of 8:00 o'clock p.m., July 5, 1972 at the Council Chambers at 13777 Fruitvale Avenue, Saratoga, California, and the City Council makes the following finding, conclusions and order as hereinafter set forth. SECTION II: The City Council finds from the evidence submitted that said hereinafter described slope easement, as described below is unnecessary for present or prospective slope easement purposes and the City further finds that at least ten (10) days prior to the aforesaid hearing said slope easement was duly and regularly posted with not less than three (3) copies of notices of said street vacation and of said hearing which notices were not posted more than 300 ft. apart, NOW, THEREFORE, said Council makes the following ord~: SECTION III: The City Council of the City of Saratoga hereby orders and declares that that certain slope ease- ment, more particularly described as follows: All that certain slope easement within Lot 73 of Tract 3101 as such slope easement, lot and tract are shown on that certain map designated "Tract No. 3101, Blue Ridge" which was filed for record in the office of the Recorder of the County of Santa Clara, California, in Book 148 of Maps at Pages 25, 26 and 27. be and the same is hereby vacated and abandoned. The above and foregoing resolution was passed and adopted by the City Council of the City of Saratoga at a regular meeting held on the 5th day of July, 1972, by the following vote: AYES: Councilmen Smith, Dwyer, Bridges, Oiridon and KraL~s ABSENT: NOB~ R
