HomeMy WebLinkAboutCity Council Resolution 630 RESOLUTION NO. ......... 630 A RESOLUTION OF THE CITY OF SARATOGA GIVING NOTICE OF INTENTION TO CALL SPECIAL ELECTION RE WESTBROOK ANNEXATION WHEREAS, this Council has heretofore, after receiving a report and recommendation from the Saratoga Planning Commission, adopted a resolution consenting to the commencement of annexa- tion of the hereinafter referred to annexation proceedings, and pursuant thereto on or about the 5th day of April, 1972, the Local Agency Formation Commission of Santa Clara County, pursuant to petition therefor, did on said date, after a hearing thereon, approve said proposal, and WHEREAS, the proponents of said annexation thereafter on or about June 21, 1972 did file with this Council their notice of intention to circulate a petition for such annexation, accompanied by an affidavit of publication of said notice and the requisite statements required therewith, and on July 5, 1972 this Council did acknowledge receipt of said notice and approve the circulation of said petition, and WHEREAS, there has now been filed with this Council, on or about August 16, 1972, a petition signed by not less than one-fourth:of the qualified electors residing within the terri- tory of said proposed annexation, as shownby the County Regis- tration of Voters, containing a description of the new territory proposed to be annexed and asking that the territory be annexed, and heretofore the City Clerk of this City and the County Officer having charge of the registration of voters have checked said petition and certified to this Council the sufficiency thereof, and good cause appearing therefor, IT Is HEREBY RESOLVED by the City Council of the City of Saratoga as follows: -1- 1. All of the statements in the preamble to this resolution hereinabove set forth are hereby adopted as findings of this Council. 2. Notice is hereby given that this Council intends to call a special election in said territory proposed to be annexed, at which election said Council intends to submit the question of annexation of said territory to the City of Saratoga to the electors residing within the said territory, said election to be held in all respects in accord with the applicable provisions of the Government Code and the Elections Code of the State of California, and 3. Notice is hereby given that on the =. l~h day of October , 1972, at the hour of 8:00 o'clock P.M. of said day, at'the City Council Chambers located at 13777 Fruitvale Avenue, Saratoga, California, a hearing will be held on said proposed annexation, at which time any person owning real property within said terri- tory proposed to be annexed may ap'pear before this Council and protest against said annexation in accord with the law applicable thereto; 4. Said territory proposed to be annexed is hereby designated by the name of Westbrook Annexation, by which it may be referred to upon the ballots used at said election, and said real' property is more particularly described on Exhibit "A" attached hereto and incorporated herein by reference; 5. The City Clerk shall cause a copy of this resolution to be published at least once a week for two weeks prior to the date of the hearing herein, in a newspaper of general circula- tion published in the City of Saratoga, there being no such newspaper of general circulation published in the territory proposed to be annexed, and in addition said City Clerk shall -2- also post a copy of this resolution not less than ten (10) days prior to the date of said hearing in at least three (3) public places within the territory'proposed to be annexed and otherwise shall comply with all applicable provisions of Government Code Section 35119 of the State of California, in reference to notice. The above and foregoing resolution was duly and regularly passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 6th day of September, 1972, by the following vote: AYES: :~oUncilmen Smith., D..~yer, Bridges, Ojri.don and Kraus NOES: None ABSENT: No.,r~..i!~ ..... ATTES~ -3- WESTBROOK ANNEleCTION 1972 -2 CITY OF SAISTOGA Exhibi~ "A" All that certain real property situate in the County of Santa Clara, State of Califon~ia, more particularly described as follows: BEGINNING at a point in the southerly boundary of Prospect Road, said southerly boundary being the city limit line of the City of Saratoga, a municipal corpomtion, and the prolognation of the centerline of Johnson Road, as said roads are shown on the map of Tract 1222 and recorded in Book 46 of Maps, Page 6 and 7, Santa Clara County Records; THENCE from said Point of Beginning, leaving City of Saratoga city limit line, north 5° 09' 39" east 20.00 feet to a brass plug in the centerline of Prospect Road; THENCE north 5° 09' 39" east 1123.31 feet along the centerline of the above mentioned Johnson Road to a RR spike; THENCE south 86°,57, 50" east 1140.54 feet to a granite monument at the northeasterly corner of the aforementioned Tract 1222, said point also being the most northerly corner of Tract 1179, Recorded in Book 44 of Maps, Page 28 and 29, Santa Clara County Records; THENCE along the northerly boundary of Tract 1179 south 61° 20' 22" east 587.42 feet to a point on the centerline of Saratoga Creek as shown on the map of the aforementioned Tract 1179, said point being south 61° 20' 22" east 27.04 feet from an iron pipe; THENCE along the centerline of said Saratoga Creek the following bearings and d~tances: SOUTH 35° 33' 23" west 156.53 feet; THENCE south 53° 16' 08" west 188.10 feet; THENCE south 31° 16' 08" west 175.56 feet; THENCE south 0° 28' 52" east 264.00 feet; THENCE south 41° 01' 08" west 287.10 feet to a point in the center- line of Prospect Road, said point also being on the City of Saratoga city limit lines; thence along said city limit line south 8~ 26' west 20 feet to the southerly boundary of Prospect Road as shown on said Tracts No's 1222 and 1179; thence along last mentioned south- erly line being in the city limits line of Saratoga, north 81~ 34' west 80.52' and north 85~ 41' west 1172.34' to the point of begin- ning.
