HomeMy WebLinkAboutCity Council Resolution 632 WJML:T...~:eJa 9/8/i2 25c RESOLUTION NO.. 632 A RESOLUTION ORDERING FORMATION OF THE NORTHWEST SARATOGA PARK MAINTENANCE DISTRICT RESOLVED, by the City Council of the City of Saratoga, California, that WHEREAS, pursuant to Chapter 26, Part 3, Division ? of the Streets and Highways Code, the Improvement Act of 1911, the City Council of said City did on the 2rid day of August, 1972, adopt its Resolution of Intention No. 626 to Form the Northwest Saratoga Park Maintenance District in said City, which is to be designated as "NORTHWEST SARATOGA PARK MAIN- TENANCE DISTRICT"; WHEREAS, said Council did declare in said Resolution its intention to order that the expense of maintaining and operating all decorative walls, walkways, crosSwalks, steps, safety zones, platforms, seats, statuary, fountains, recreation areas, parks and parkways, signs, poles, posts, wires, pipes, conduits, lamps, and other suitable and necessary appliances for the purposes of lighting streets, places or public ways, water mains and sprinkler systems, and ornamental planting including lawns, shrubs and trees, now existing or hereafter to be constructed in or for said Maintenance District, and of benefit to said Maintenance District but not of benefit to the City of Saratoga, as a whole, including the cost of necessary repairs, replacements, water, fuel, power, gas, electric current, care, supervision, and any and all other items necessary for the proper maintenance and operation thereof, shall be assessed wholly upon the real property within said Main- tenance District, as hereinafter described, which district said Council determined would be the district benefited by the main- tenance and operation of said improvements, and that the amounts so assessed were to be levied and collected in the same manner and by the same officers as taxes for City purposes are collected~ and WHEREAS, said Resolution was duly published, and notices of its passage were duly posted and mailed for the time and in the form and manner provided by law, all as more particularly appears from the affidavits thereof on file in the office of the City Clerk~ NOW~ THEREFORE, IT IS HEREBY ORDERED, as follows: 1. That the expenses of maintaining and operating all ornamental planting including lawns, shrubs, trees and !andscaping~ water mains, sprinkler systems now in existence or hereafter to be planted, installed or constructed and of benefit ,to said Maintenance District but not of benefit to the City of Saratoga as a whole and located within that portion of the public street right of way in and immediately adjacent to the intersection of Kirkmont Drive and Sunnyvale-Saratoga Road and the intersection of Covina Court and Prospect Road within said District and as shown on exhibit "B" attached hereto and incorporated herein by reference, together wit.b and including the cost of necessary repairs, replacements, water, care, supervision and any and all other items necessary for the proper maintenance and operation thereof, shall be assessed wholily upon the real property within said Maintenance District described herein, which District said Council hereby determines will be benefited by the maintenance and operation of said improvements, and that the amounts so assessed are to be levied and collected in the same manner and by the same officers as taxes for City purposes are levied and collected. 2. It is further ordered that the expenses of maintaining and operating all poles, posts, wires, pipes, conduits, lamps and other suitable and necessary appliances for the purposes of lighting - 2 - streets, places or public ways, now existing or hereafter to be constructed in or for said Maintenance District and of benefit to said Maintenance District but not of benefit to the City of Saratoga as a whole, including the costs of necessary repairs, replacements, fuel, power, gas, electric current, care, supervision, and any and all other items necessary for the proper maintenance and operation thereof, shall be assessed wholly upon the real property within said Maintenance District above described, which district said Council hereby determines will be the District benefited by the maintenance and operation of said improvements, and that the amounts so assessed are to be levied and collected in the same manner and by the same officers. as taxes for City purposes are levied and collected. 3. That all of the lands contained within the said main- tenance district are benefited by the improvements to be maintained by said District, and that all of the lands so benefited are in- cluded within the boundaries so described. 4. That said District be, and it is hereby, designated as "Northwest Saratoga Park Maintenance District" by which name it shall hereafter be referred to in all subsequent proceedings, including proceedings for the levy and collection of taxes, and that said amount so assessed shall be levied and collected in the same manner and by the same officers as taxes for City purposes are levied and collected. 5. That the District and the boundaries thereof benefited and to be assessed for the maintenance and operation of the im- provements so described, are situate in the City of Saratoga, County of Santa Clara, State of California, and are more parti- cularly described in Exhibit "A" attached hereto and by reference incorporated herein. -3- 6. That the City Clerk shall file a certified copy of this Resolution in the office of the County Assessor of Santa Clara County, and that said County Assessor shall hereafter, in making up the City assessment roll, segregate the property included within said District on the assessment roll under the designation contained in this resolution, all as required by Section 58~9 of the Streets and Highways Code of the State of California. 7. That the City Clerk shall file a certified copy of this Resolution and the map or plat, indicating the boundaries of said District with the State Board of Equalization and said County Assessor, as required by Section 54900, et seq., of the Government Code of the State of California. I hereby certify that the foregoing is a full, true and correct copy of Resolution duly passed and adopted by the City Council of the City of Saratoga, California, at a meeting thereof held on the ~20~h day of September, 197~, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Smith~ Dwyer, Bridges, Diridon and Kraus NOES, Councilmen: None ABSENT, Councilmen: None APPR0~E~~~~ / V ~ayor EXHIBIT "A" NORTHWEST SARATOGA PARK MAINTENANCE DISTRICT BEGINNING at the most southwesterly corner of that certain Tract No. 2967 Kirkmont of Saratoga, recorded on July 30, 1962 in Book 150 of Maps at Page 29, Santa Clara County Records. THENCE, leaving said point of beginning running north 0° 28' east ~'12.50 feet, THENCE, south 88° 00' west 12.50 feet, THENCE, running north O° 28'east 484.04 feet to a point on the southerly right-of-way line of Kirkmont Drive as shown on that certain map of Tract 2967. Said point also being on a .curve, lying concave to the 'south and having a radius of 470 feet. THENCE, along said curve, to the left for an arc length of 81.51 feet through a central angle of 9~ 56' 10" to a point of tangency with a reverse curv. e .to the right and having a. radius of 530 feet. THENCE along said curve to the rightS, for an arc length of 91.91 feet through a central angle of 9~ 56' 10' to a point of tangency. THENCE, south 88~ 05' 15" west 248.80 feet to a tangent curve to the left, and having a radius of 20 feet.
