HomeMy WebLinkAboutCity Council Resolution 653-1 RESOLUTION NO. 653-1 RESOLUTION ESTABLISHING ENVIRONMENTAL IMPACT REPORT CRITERIA, PROCEDURES AND OBJECTIVES FOR PUBLIC NON-LAND.'g~PRDJECTS"~:' IN THE 7CITY'OF' SARATOGA. The City Council of the City of Saratoga does hereby resolve as follows: Section 1: Reference is hereby made to Resolution No. 653 Of this City heretofore adopted this day, setting forth C~iteria, procedures and objectives for private 1. and projects in the City of Saratoga under the California Environ- mental Quality Act of 1970. Pursuant to Public Resources Code Section 21082 of the State of California and Section 15~4 of the California Administrative Code, all of the provisions of said Resolution No. 653 relating to land projects shall, with the exception of Paragraph (5) of Section 2 thereof, be equally applicable to all other projects within the City, including discretionary activities undertaken directly by City, discretionary activities undertaken b y any person which are supported in whole or in part through contracts, grants, subsidies, loans or other forums of assistance from the City, and activities involving the issuance to a person of any lease, permit, license, certifi. cate or other entitlement for use.ll for a non-land project, by the City or any officer, Board, or agency thereof. Section 2: On all discretionary projects not categori- cally exempt, th~ Director shall determine whether the project may have a substantial adverse impact on the environment. In making such determination he shall follow the genera]. guidelines set forth in Sections 15080 through 15083 of the California Administrative Code, together with such additional specific criteria as may from time to time be promulgated and established by subsequent resolution of this City. The Director of Planning and Director of Public Works are hereby jointly directed to make a study and report to this Council, within . ~0 days from date hereof, setting forth recormnendations as to more specific criteria to be used by the Director in determining whether a public project may or may not have a effect on the environment. Within 20 days after request by the Director of Public Works as to all projects directly undertaken by the Cit!~, and within 10 days after the filing of any application or request by any person for support of a project.. in whole or in part through a contract, grant, subsidy, loan or other form of assistance from the City, the Director shall make his determina- tion as to whether the discretionary project may or may not have a substantial adverse impact on the environment, and shall indicate his determination by executing Form EIA-2, delivering one copy to the applicant and one copy to the City Manager for delivery to the City Council. -1- Section 3: All reference to "Applicant" in Resolution No. 653 ....... ~hall mean the City of Saratoga on all project activ~"~s directly undertaken by said City, and shall mean the person requesting or petitioning for support as to any project activity to be aided in whole or in part through any contract, grant, subsidy, loan or other form of assistance from the City. Section 4: The within resolution is intended to be interim onIy, and is separated from Resolution No. 653 relat- ing to private land projects, so that more detailed drl't~ria may be developed for public projects, and in order to study the feasibility of the adoption of a permanent procedure for public projects differing from the procedure utilized in private projects. In this regard the Departments of Planning and Public Works of this City are directed to continue their study and of environmental impact report criteria, procedures and objectives with a view to recommending the implementation of a.more permanent set of regulations and guide- lines within a reasonable for public projects.
