HomeMy WebLinkAboutCity Council Resolution 705 RESOLUTION NO. 705 RESOLUTION DESCRIBING PROCESS TO BE USED IN SANTA CLARA COUNTY TO IMPLEMENT THE FEDERAL AID URBAN PROGRAH WHEREAS, the Federal Aid Highway Act of 1973 provides Federal funds for expenditures on the Federal Aid Urban (FAU) System of Highways or, under certain conditions, for public transportation projects; and WHEREAS, the FAU System consists of State high~ays, city streets and County roads located ~ithin urban areas and urbaniFed areas of the State; and WHEREAS, the State Department of Transportation has required that each urbaniFed and urban area must have a cooperative process to produce a 3-year program identifying local pro~;ects, transit projects and regional highway projects, including State highray projects; and WHEREAS, the cooperative process must involve the cities, the County, the County Transit District, the Metropolitan Transportation Agency, and the State; and WHEREAS, before Federal aid ~ill be made available for Urban System pro- jects within Santa Clara County,. the process for determining project prior- ities and developing a three (3) year program must be approved by MTC with regard to the regional interest, and by the State Department of Transportation; and WHEREAS, ~he:~,eaunty of Santa Clara has been designated as the lead agency for purposes of developing the cooperative process in Santa Clara County; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Saratoga hereby approves the following process and procedures for determining Federal Aid Urban System project priorities and developing a three (3) year Federal and Urban System Program and requests that they be approved by the State Department of Transportation: -2- 1. The County of Santa Clara will exchange County Gas Tax Funds Vith the other cities in the County, with the exception of San Jose, for 22.1% of the total FAU funds allocated to Santa Clara County. These funds will be allocated to the individual cities in accordance with the following provisions and are equal to the amount of money ~-hich would be available to each city on a prorata basis according to population once allot-ances for regional transportation needs, public transportation, the City of San Jose and the unincorporated County area shares are made. a.) The latest Sta~e Department of Finance population figures will be used in determining the prorata shares° Based on 1972 figures the following percentages reflect each city's share: City Share Campbell 1.2% Cupertino 1.0% Gilroy 0.6% Los Altos 1.1% Los Altos Hills 0.3% Los Gatos 1.1% Milpitas 1.4% Monte Sereno 0.2% Morgan Hill 0~4% Mountain View 2.6% Palo Alto 2.4% Santa Clara 4.1% Saratoga 1.3% Sunnyvale 4.4% 22.1% b.) The exchange of County Gas Tax Funds to the cities ~ill be made at a 30% discount rate to reflect the additional administrative costs and the requirement for additional matching funds by the County. -3~ c.) Payment to the cities by the County w~ll be made ~ithin 43 days after the County actually receives the FAU funds. d.) The County Gas Tax funds exchanged ~ith the cities must be spent by the cities for legal Gas Tax fund purposes. The three (3) year FAU program will be developed by a committee which includes a representative from the County of Santa Clara, the City of San Jose, CALTRANS and MTC. a.) The three (3) year programmay include projects submitted by CALTRANS, the County Transit District, the City of San Jose and the County of Santa Clara. b.) The follo~.~ing distribution of FAU funds will be used as a guideline in the development of the three (3) year FAU program: Regional Transportation (including public transportat~6n~ 50% City of San Jose projects 22% County of Santa Clara projects 28% 100% c.) The following criteria will be used in evaluating projects and developing a three (3) year program: (1) State of readiness (status of plans, specifications, estimate, EIR, approvals, agreements~ etc.) (2)Benefit to public transportation system. (3)Transportation corridor benefit, Benefit to total transportation capacity (ability to handle person trips per day). (5) Benefit to other segments of the Regional and local highway system. (6)Benefit to accident history. (7)Community and environmental considerations. d.) The three (3) year FAU program will be approved by the City Council of San Jose, the County Transportation Commission (for that portion of the program ~ich involves regional and public transportation projects), and the County Board of Supervisors. It shall then be transmitted by March 1 of each year to the Metropolitan Transportation Commission for review and approval with regard to regional interest and to the Director of the State Department of Transportation. for approval. e.) Said three (3) year program shall be reviewed and revised each year to include additional projects as submitted by eligible agencies and revisions shall be approved as provided in paragraph 2(d). 3, The above described process will be reviewed and approved in the following IllarmOr. It shall first be referred to the County Transportation Commission for approval, b.) Once approved by the Transportation Commission, the process will then be referred to each City Council and must be approved by: (1) The majority of cities in the County eligible for the FAU program. (2) Cities in the County representing the majority of the eligible population. (3) Cities in the County with over 200,000 population (the City of San Jose). c.) Once the requirements defined in paragraph 3 (b) above are satisfied, the process shall be submitted to the County Board of Supervisors for approval. d.) Once approved by the Board of Supervisors, the process shall then be transmitted to the Metropolitan Transportation Commission for approval with regard to the regional interest and to the Director of the State Department of Transportation. BE IT FURTHER RESOLVED THAT the LLhigh~Tay system shown on the attached map be approved as the FAUnHighway System for Santa Clara County.
