HomeMy WebLinkAboutCity Council Resolution 716 ~CITY OF SARATOGA RESOLUTION NO. ~ RESOLUTION REQUESTING THE BOARDS OF TRUSTEES OF CAMPBELL UNION SCHOOL DISTRICT, CUPERTINO UNION SCHOOL DISTRICT, MORELAND SCHOOL DISTRICT, SARATOGA UNION SCHOOL DISTRICT, LOS GATOS-SARATOGA UNION' HIGH SCHOOL DISTRICT, CAMPBELL UNION HIGH SCHOOL DISTRICT, FREMONT UNION HIGH SCHOOL'DISTRICT, WEST VALLEY COMMUNITY COLLEGE DISTRICT AND FOOTHILL COMMUNITY COLLEGE DISTRICT AND THE COUNTY SUPERIN- TENDENT OF SCHOOLS OF SANTA CLARA COUNTY AND THE REGISTRAR OF VOTERS OF SANTA CLARA COUNTY TO PROVIDE FOR THE CONSOLIDATION OF A SPECIAL MUNICIPAL BOND ELECTION WITH THE CAMPBELL UNION SCHOOL DISTRICT, CUPERTINO UNION SCHOOL DISTRICT, MORELAND SCHOOL DISTRICT, SARATOGA UNION SCHOOL DISTRICT, LOS GATOS-SARATOGA UNION HIGH SCHOOL DISTRICT, CAMPBELL UNION HIGH SCHOOL DISTRICT, FREMONT UNION HIGH SCHOOL DISTRICT, WEST VALLEY.COMMUNITY COLLEGE DISTRICT AND FOOTHILL COMMUNITY COLLEGE DISTRICT GOVERNING BOARD MEMBER ELECTIONS TO BE HELD MARCH 4, 1975 WHEREAS, the City Council (hereinafter sometimes called the "Council") of the City of Saratoga (hereinafter called the "City"), has heretofore duly passed a resolution of public interest and necessity preliminary to the adoption of an ordinance calling a special municipal bond election in the Cit~ to be held on Tuesday, March 4, 1975, at which will be submitted to the qualified electors of the City a measure for incurring bonded indebtedness of the City as hereinafter set forth; and WHEREAS, Campbell Union School District, Cupertino Union School District, Moreland School District, Saratoga Union School District, Los Gatos-Saratoga Union High School District, Campbell Union High School District, Fremont Union High School District, West Valley Community College District and Foothill Cor~nunity College District Governing Board Member Elections will be held on Tuesday March 4, 1975, and it is the desire of the Council that said special municipal bond election be consolidated with said governing board member elections; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saratoga, as follows: Section 1. Said special municipal bond election is hereby called to be held in the City and the same shall be consolidated with the Campbell Union School District, Cupertino Union School District, Moreland School District, Saratoga Union School District, Los Gatos-Saratoga Union High School District, Campbell Union High School District, Fremont Union High School District, West Valley Community College District and Foothill Community College District Governing Board Member elections to be held on Tuesday, March 4, 1975, at which elections shall be submitted to the qualified electors of the City the following measure, to wit: MEASURE ( ): Shall the City of Saratoga (Library) incur a bonded indebtedness in the principal amount of $1,200,000 for the acquisition, construction and .completion of the following municipal improvement, to wit: A new public library, including land, building, landscaping, site development and parking facilities, together with furniture, fixtures, books and equipment therefor; and other works, property or structures necessary or convenient for a new public library for the City of Saratoga? Section 2. The Boards of Trustees of the Campbell Union School District, Cupertino Union School District, Moreland School District, Saratoga Union School DistriCt, Los Gatos-Saratoga Union High School District, Campbell Union High School District, Fremont Union High School District, West Valley Community College District and Foothill Community College District and the County Superintendent of Schools of Santa Clara County are hereby requested to order the consolidation of said special municipal bond election with said governing board member elections to be held on Tuesday, March 4, 1975, insofar as the City is concerned, and to further provide that within the territory affected by said order of consolidation, to wit,- the City, the election precincts, polling places and voting booths shall in every case be the same, and there shall be only one set of election officers in each of said precincts. Said measure for incurring bonded indebtedness hereinabove set forth shall be set forth in each form of ballot to be used at said election insofar as the same is held within the City. Said Boards of Trustees and said County Superintendent are further requested (i) to order the Registrar of Voters of the County to set forth on all sample ballots relating to said consolidated elections, to be mailed to the qualified electors of the City, said measure hereinabove set forth, and to mail with said sample ballots to said electors printed copies of arguments (if any) for and against said measure and a tax rate statement, and (ii) to provide absent voter ballots for said governing board member elections and said special municipal bond election consolidated therewith for use by qualified electors of the City who are entitled thereto, in the manner provided by law. Section 3. Said Registrar of Voters is hereby further authorized to canvass, as provided by law, the returns of said special municipal bond election with respect to the votes cast on said measure and to certify such canvass of the votes cast for and against said measure to the Council. Section 4. The City Clerk is hereby authorized and directed to certify to the due adoption of this reso- lution and to transmit copies hereof so certified to said Boards of Trustees and to said County Superintendent and to file a copy hereof so certified with the Registrar of Voters of the County. 4 PASSED AND ADOPTED December 10, 1974, by the following vote: AYES: Councilmen Diridon, Brigham, Kraus and Bridges noes; None absent None Mayor of the City of Sara~ga {SEAL] Attest: CLERK'S CERTIFICATE I, Robert F, Beyer , City Clerk of the City of Saratoga, State of California, do hereby certify that the foregoing is a full, true and correct copy of a resolution duly adopted at an adjourned regular meeting of the City Council of said City duly and regularly and legally held at the regular meeting place thereof on the 10th day of December, 1974, of which meeting all of the members of said City Council had due notice and at which not less than two-thirds of the members thereof were present and acted; that at said meeting said resolution was introduced by Councilman Br~dqes and read in full and was thereupon, upon motion of Councilman Brigham , seconded by Councilman Dir~don , adopted by the following vote: AYES: Councilmen Dirid0n, Brigham, Kraus and Bridges NOES: None ABSENT: None That I have carefully compared the same with the original minutes of said meeting on file and of record in my office; that said resolution is duly entered of record in the minutes; that the foregoing is a full, true and correct copy of the. original resolution adopted at said meeting and entered in said minutes; that said resolution has not been amended, modified or rescinded since the date of its adoption and that the same is now in full force and effect.
