HomeMy WebLinkAboutCity Council Resolution 809 RESOLUTION NO. 809 RESOLUTION PROVIDING FINDINGS CONCERNING ADOPTION OF THE UNIFORM FIRE CODE AND CHANGES OR MODIFICATIONS THEREOF WHEREAS, the Saratoga City Council has heretofore adopted the 1970 editions of the Uniform Building Code, Uniform Housing Code, Uniform Mechanical Code, Uniform Plumbing Code and 1971 edition of the Uniform Electrical Code pursuant to the authority set forth in section 17922 of the Health and Safety Code and sections T25-1050 through T25-1082 of Title 24 of the California Administrative Code as the construction codes for the County of Santa Clara; and WHEREAS, the City Council has heretofore adopted the 1973 Uniform Fire Code; and WHEREAS, sections 17958.5 and 17958.7 of the Health and Safety Code authorize the City to make changes or modifications in such codes as deemed reasonably necessary because of local conditions upon express finding that such modifications or changes are needed; and WHEREAS, this City Council desires to make certain changes or modifications in such codes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saratoga State of California, that it hereby finds and determines that the following designated changes or modifications are reasonably necessary because of local conditions set forth hereafter: l. The Uniform Fire Code The Uniform Fire Code is adopted because local conditions in the City of Saratoga require the adoption of the uniform fire code to ensure adequate fire prevention and suppression measures. Portions of the City of Saratoga are subject to possible earthquake hazards. The City must maintain uniform standards with respect to fire prevention in order to minimize the potential of massive and severe fire danger and damage caused by earthquakes. Portions of the City of Saratoga are rural fire hazardous areas that have little or no fire suppression services available. For the protection of life and property, adoption and enforcement of a uniform fire prevention code is imperative. 2. Amendments impacting onhousing uniform Fire Code sections 13.301 (d}, 13.310(d}, 13.311(a), 13,312(d), 13.313 and 13.309.1; section 13.301 (d) refers to Saratoga City Ordinance 38.50 section 6-2.15. Certain areas in the City of Saratoga have a limited availability of water for fire suppression. Saratoga has some earthquake hazard areas. Built-in fire protection systems distinctly reduce fire loss potential in such areas. Uniform Fire Code, Appendix E. The combination of weather, vegetation and topography in certian rural areas of the City necessitate the requirement of fire retardant or special! purpose roof coverings on new buildings, including dwellings. BE IT FURTHER RESOLVED that the Uniform Fire Code is revised so as to reflect current City administration and enforcement of matters regulated by the code.
