HomeMy WebLinkAboutCity Council Resolution 841 RESOLUTION NO. 841 RESOLUTION ORDERING VACATION AND ABANDONMENT OF A SLOPE EASEMENT The City Council of the City of Saratoga does hereby resolve as follows: SECTION I: Pursuant to Part 3 of Division 9 of the Streets and Highways Code of the State of California, a hearing was held on this Council's proposal to vacate and abandon the hereinafter referred to street, at the hour of 8:00 o'clock p.m., February 15, 1978 at the Council Chambers at 13777 Fruitvale Avenue, Saratoga, California, and the City Council makes the following finding, conclusions and order as hereinafter set forth. SECTION II: The City Council finds from the evidence submitted that said hereinafter described slope easement, as described below is unnecessary for present or prospective slope easement purposes and the City further finds that at least ten (10) days prior to the aforesaid hearing said slope easement was duly and regularly posted with not less than three (3) copies of notices of said street vacation and of said hearing which notices were not posted more than 300 ft. apart, NOW, THEREFORE, said Council makes the following order: SECTION III: The City Council of the City of Saratoga hereby orders and declares that that certain slope ease- ment, more particularly described as follows: All that certain slope easement within Lot 55 of Tract 3439 as such slope easement, lot and tract are shown on that certain map designated "Amended Map of Tract No. 3439, Sarahills, Unit No. 2" which was filed for record in the office of the Recorder of the County of Santa Clara, California, in Book 226 of Maps at Pages 47 and 48. be and the same is hereby vacated and abandoned. The above and foregoing resolution was passed and adopted by the City Council of the City of Saratoga at a regular meeting held cn the 15th day of February, 1978, by the following vote: AYES: Councilmen Brigham, Bridges, Corr, & Kraus NOES: None ABSENT: Councilman Matteoni MAYO} ATTEST: CITY C2
