RESOLUTION ABANDONING PORTION OF
PUBLIC UTILITY EASEMENT
WHEREAS, it appearing that the hereinafter described portion of a
public utility easement is no longer necessary for the purpose intended
and has not been in use for the past twelve (12) months, and the City
Council of the City of Saratoqa being so advised and good cause appearing,
NOW, THEREFORE, BE IT RESOLVED that the hereinafter described por-
tion of easement be and the same is hereby abandoned, save and except
therefrom for the purpose of wire clearance. Said portion so abandoned
as above referred to is described as follows:
That certain portion of land situated in the City of Saratoga,
County of Santa Clara, State of California, more particularly described
as follows:
Commencing at the northwesterly corner of Lot 40 as shown
on that certain map of Tract No. 3034, recorded on May 17,
1963, in Book 161 of Maps at Page 26, Santa Clara County
Recorder's Office; thenc8 running along the northerly line
of said Lot 40, North 89 29' 25" East 5.00 feet to the
TRUE POINT OF BEGINNING: thence continuing along the said
northerly line of said Lot 40, North 89 29' 25" East 5.00
feet to the point of intersection with the easterly line of
that certain 10 foot Public Utility Easement shown along
the westerly end of said Lot 40; thence running South 0 30'
35" East 69.65 feet along said easterly line to the southerly
line of said Lot 4g; thence running along said southerly line
of Lot 40 North 67 16' 30" West 5.44 feet; thence running
North 0° 30' 35" West 67.50 feet along a line that is parallel
to and 5.00 easterly of the westerly line of said Lot 40 to
the northerly line of said Lot 40 and the TRUE POINT OF
BEGINNING.
The above and foregoing resolution was regularly introduced and
thereafter passed and adopted on the 7th day of JlLne , 1978,
by the following vote at a regular City Council Meeting of the City of
Saratoga.
