HomeMy WebLinkAboutCity Council Resolution 857 RESOLUTION NO. 857 A RESOLUTION VACATING AN EASEMENT TRACT NO. 5243 WHEREAS, it appearing that the hereinafter described portion of roadway easement is no longer necessary for the purposes intended and has not been in continuous use from its acceptance more than one (1) year ago but less than five (5) years ago, and the City Council of the City of Saratoga being so advised and good cause appearing and the portion of said easement being vacated being unnecessary for present and prospective use, NOW, THEREFORE, BE IT RESOLVED that the hereinafter described portion of roadway easement only be and the same is hereby vacated and abandoned. Said portion so vacated as above-referred to is described on the attached Exhibit "A" and shown on the attached Exhibit "B" Reserving, however, from such vacation the existing Public Utility Easement and Sanitary Sewer Easement, within said ~escribed area which shall be retained and remain in full force and effect. The above and foregoing resolution was regularly introduced and thereafter passed and adopted on the 21st day of....june , 1978, by the following vote at a regular City Council Meeting of the City of Saratoga. ' '~ '"' ~i ii '~ .... i EXH 8 T "A " BEGINNING at the northwesterly corner of Lot 10 as shown on that map of Tract No. 5243 recorded on the 6th day of October, 1972 in Book 310 of Maps at Page 9, Santa Clara County Records, said point of beginning also lying on the westerly boundary of said Tract No. 5243; thence running along the westerly boundary of Tract No. 5243 North 0° ~2' 00" West 22.07 feet; thence North 64 08' East 45.69 feet to a point on the westerly line of the cul-de-sac as shown as Harleigh Drive on said Tract No. 5243; thence running South 0° 52' 00" East 2.48 feet along said cul-de-sac to the point of tangency with a curve to the left and having a radius of 42-feet6 thence running along said curve to the left, through a central angle of 53 26' 13", for an arc length of 39.17 feet;-thence South 64 08' West 64.43 feet to a point on the westerly boundary of ~ract 5243~ thence.running along said,~esterly boundary North 0 52' 00" West 22.07 feet to the northwesterly corner of said Lot 10 and the point of BEGINNING. EXCEPTING THEREFROM, the following described 20 foot strip of land to remain clear and open for the purposes of Sanitary Sewer Easement, Public Utility Easement and Roadway Easement. BEGINNING at the northwesterly corner of Lot 10 as shown on that map of Tract No. 5243 recorded on the 6th day of October, 1972 in Book 310 of Maps at Page 9, Santa Clara County Records, said point of beginning also lying on the westerly boundary of said Tract NQ6 5243; thence running along the westerly boundary of Tract No. 5243 North 0 52' 00" West 16.36 feet; thence North 63 03' 32" East 46.17 feet to a point on a curve to the left, and having a radius 42 feet, said point also lying on the westerly line of the cul-de-sac as shown as Harleigh Drive on said Tract No. 5243; thenc8 running along said curve to the left, from ~ tangent that bears South 3 55' 55" East, through a central angle of 27 39' 22" for an arc length of 20.27 feet; thence South 63° 03" 32" West 52.67 feet to a point on the westerly boundar~ of Tract No. 5243; thence running along said westerly boundary North 0 52' 00'~ West 5.71 feet to the northwesterly corner of said Lot 10 and the point of BEGINNING.
