OF THE COUM~ OF SANTA Cl~ ~KING D~E~I~TIONS
A~ APPROVlNG ~E PROPOS~ REORG~NIZATION
OF T~RITORY, DESIG~T~ AS: MOUNT EDEN ROAD 79-1

RESOLVED, by the Local Agency Formation Comissl. on of the County
of Santa Clara, State of California, that
W~!EREAS, a petitlon/~ for the proposed reorganization
consistin_g~cf. anne,.xation to the City of Saratoq~, The S~ratoc~a Fi!e
District, and the Cuper'tino Sanitsrv Sewer District
in the County of Santa Clara was herekofore filed by the
landowners and accepted for filing on
March 1.25~ ].979 by the Executive Officer of this Local Agency
Formation Commission pursuant to (Title 6, Divis[___o3 1, comme_2~c__in_~ with

~ et seq. of the Government Code; and
WHERFAS, the Executive Officer, pursuant to Government Code
Sectf. c,n 54794, has reviewed th!,,~ proposal and prepared a report
cluding his ~'econm~,.nd-atfons thereon, and has furnished a copy of this
report to each person entitled to a copy; and
WHEREAS~ it aFpe~r~ to the satisfaction of this Con~nlssion that
all owners of land included in said proposal consent to said proceeding;
and
WHEREAS, this Commission on May 2, 19..7...9 ........ ,heard from
the interested parties, considered t~e proposal and the report of the
Execu. t[ve Offictr, and considered the factors determined by the
mission to be relevan~ to this proposal, including, but not limited
to, factors specified in Government Code Section 54796; a~d
WHEREAS, this Co=a~ission has reviewed and considered the Envlr_~on_~

County of Santa Clara DOES HERE~Y RESOLVE, DETER~INE and ORDER a8
follows:
Section I, This Commission 8o cert~.fie~ it has reviewed and
considered t~s b~v~ront~ent~l:I_mp_actR~}LorJ~_~~e
Section 2. ~Insert Environmental Findings)
The Commission finds that there will not be an
adverse environmental impact on the project.
Section 3. Subject to the terms and conditions heroinafter
specified, said proposal ts approved.
Section 4. The boundar£es of the territory proposed to be
reorganized_ , as set forth in the
proposal or as amended by condition, are hereby
approved as described in Exhibit "A", attached heroin
and made a part hereof, Said territory is found to
be _Jdjl_inhabited, and said territory is assigned the
following distinctive short form designation:
MOUNT EDEN ROAD 79-1 (DE MARTINI)
Sect[on 5. Any resolution ordering such reorqanization
shall provide that such. __-_r~,PJ~Ln_ _
shall be made subject to the following terms and con-
ditions:
(a) Subject to payment of fees as noted in Article III:
Section 4300 Annexation Requirements of the CuD~rt]no
Sanitary District Operations Code p~ragraph (b).

Section 6. The City. of Saratoc~
is designated as the conducting ~4~-g~r-4~authority. and
the legislative body thereof is hereby dt. rected to
initiate reorganization proceedings in com-
pliance with this resolution.
Section 7. Proceedings of the governing board of the conducting
d~/authority may be held withou~ notice and'
hearing, without an election, or boric, pursuant to
Section ~56439.5/B~.~3~q~ of the Government
Code.
Sectiot~ 8. Any election called upon the question of confirming
an order for~a=_n=p~_>:3_~c~__o.n/_de!.achn~em[) shall he: called,
held and conducted upon such question only within
the territory ordered to be annexed/detached.

Section 9. The Executive Officer is hereby authorized and
directed to mail certified copies of this resolution
in the manner and as provided in Section
of the Government Code. In addition, said Executive
Officer shall also mail to said conducting
autborit_Z a copy of the petition or resolution
accompanying said proposal.
