A RESOLUTION AUTHORIZING IN REM VALIDATING PROCEEDINGS
VILLAGE PARKING DISTRICT NO.2 ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, this Council has conducted special assessment and
assessment bond proceedings for the formation of the assessment
district identified in the title and has confirmed the assessment
upon the several subdivisions of land within said assessment
district, all as provided in the Municipal Improvement Act of 1913,
Division 12 of the Streets and Highways Code of the State of
California; and
WHEREAS, Section 10601 of said Municipal Improvement Act of
1913, provides that an action to determine the validity of the
assessments and bonds may be brought pursuant to Chapter 9
(commencing with Section 860), Title 1O, Part 2 of the Code of Civil
Procedure;
NOW, THEREFORE, IT IS ORDERED that Wilson, Morton, Assaf &
McElligott, bond counsel for the City are hereby authorized and
directed to initiate and prosecute to conclusion an action or
actions pursuant thereto to determine the validity of said
assessments and bonds proposed to be issued to represent the unpaid
assessments against said several subdivisions of land, and to take
such action as may be necessary therein.

I hereby certify that the foregoing is a full, true and
correct copy of a resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
held on the 7th day of February, 1979, by the following vote of the
members thereof:

Kraus, Corr, Matteoni, Kalb, & Callon
NOES, Councilmen:
None
