WMAM:PDA:rva 12/28/ .~ 12c RESOLUTION NO. 889 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE ACQUISITION AND CONSTRUCTION OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE VILLAGE PARKING DISTRICT NO. 4 ASSESSMENT DISTRICT RESOLVED, by the Council of the City of Saratoga, California, that WHEREAS, all of the owners of more than 60% in area of the property subject to assessment therefor have signed and filed with the City Clerk of this City a written petition for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited by said improvements, and waiving proceedings under Division 4 of the Streets and Highways Code of the State of California, for the acquisitions and improvements more particularly described in Exhibit "A" hereto attached and by reference incorporated herein; WHEREAS, the costs and expenses of said contemplated acquisitions and improvements are to be chargeable upon an assessment district, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area shown on a map thereof entitled "Proposed Boundaries of Village Parking District No. 4 Assessment District", on file in the office of the City Clerk, to which reference is hereby made for further particulars; and WHEREAS, the public interest and convenience will be served by the taking of said proceedings; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that all of the owners of more than 60% in area of the property subject to assessment for said proposed acquisitions and improvements have filed with the City Clerk of this City a written petition for the acquisition and construction of improvements pursuant to appropriate special assessment and assessment bond acts, without further compliance with the provisions of Division 4 of said Streets and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that said proceedings for the acquisition and construction of said improvements shall be had pursuant to the Municipal Improvement Act of 1913, Division 12 of said Streets and Highways Code, and the bonds upon the unpaid assessments thereof shall be issued pursuant to the Improvement Bond Act of 1915, Division 10 of said Streets and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that the provisions of Division 4 of the Streets and Highways Code be, and they are hereby dispensed with. EXHIBIT "A" a) The acquisition of that certain real property situate in the City of Saratoga, County of Santa Clara, State of California, more particularly described as follows: Lands to be acquired by the City of Saratoga, County of Santa Clara, State of California for Parking District No. 4. BEGINNING at the Southwesterly corner of Lot 10, Block 6, as said corner is shown upon the map of "Town of McCartysville" said map filed in the Office of the Recorder of the County of Santa Clara, State of California on September 28, 1870, in Book "A" of Maps at Page 43, said corner also being on the Northerly line of Oak Street; thence North 47° 00' 00" West 98.00 feet to the TRUE POINT OF BEGINNING: South 43© 00' 00" West 100.00 feet; thence South 47° 00' 00" East 23.00 feet; thence, South 43° 00' 00" West 50.00 feet to a point on the Easterly line of Fourth Street; thence along said Easterly line North 47° 00' 00" West 135.00 feet; thence leaving said line North 43° 00' 00" East 220.00 feet; thence South 47° 00' 00" East 29.00 feet; thence North 43° 00' 00" East 80.00 feet to a point on the Westerly line of Third Street; thence along said Westerly line South 47° 00' 00" East 24.00 feet thence leaving said line South 43° 00' O0" West 100.00 feet; thence South 47° 00' 00" East 13.00 feet; thence South 43° 00' 00" West 50.00 feet; thence South 47° 00' 00" East 46.00 feet to the TRUE POINT OF BEGINNING. Said parcel containing 24230.00 feet or 0.556 acres of land. and the improvement thereof by clearing, grubbing, excavation, grading, removal of existing trees, shrubs and structures and construction therein of base, pavement, curbs, gutters, sidewalks, surface and subsurface storm drainage facilities, where required, lighting facilities, wheel stops, striping, signing, driveway approaches, and landscaping, including irrigation facilities, together with all work auxiliary to any of the above and necessary to complete the same as off-street parking facilities. b) The acquisition of all lands and easements and the performing of all work auxiliary to any of the above and necessary to complete the same as off-street parking facilities.
