A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA REQUESTING DESIGNATION OF
STATE HIGHWAY-ROUTE 9 BETWEEN BLANEY PLAZA
IN THE CITY OF SARATOGA AND THE COUNTY LINE
AT SARATOGA GAP (THE SKYLINE) AS AN "OFFICIAL
STATE SCENIC HIGHWAY" AND PROVIDING FOR A
CORRIDOR PROTECTION PROGRAM
WHEREAS, the City of Saratoga by its Resolution No. 515 of
November 19, 1969, declared its intention to conduct a study for the
purpose of qualifying that portion of State Highway 9 between Blaney
Plaza in the City of Saratoga and the County Line at Saratoga Gap
(The Skyline) as as "Official State Scenic Highway" and requested
the assistance of the District Director of the California Department
of Transportation, District IV, in the preparation of such study; and
WHEREAS, the Board of Supervisors of the County of Santa Clara,
the only other local agency having jurisdiction over said portion of
State Highway 9, adopted a similar resolution on April 16, 1975; and
WHEreAS, in due course, pursuant to the provisions of the
State publication, "The Scenic Highway Route/A Guide for the Desig-
nation of an Official Scenic Highway," the said District Director
did prepare in consultation and cooperation with the two aforesaid
local agencies, a Scenic Highway Corridor Survey and a Scenic Facility
Study pertaining to said portion of State Route 9; and
WHEREAS, in order to establish State Highway 9 between Blaney
Plaza in the City of Saratoga and the County Line at Saratoga Gap
(The Skyline) as a Scenic Highway, certain policies must be adopted
and implemented by the two jurisdictions involved, namely the County
of Santa Clara and the City of Saratoga; and
WHEREAS, the Board of Supervisors of the County of Santa
Clara, by its Resolution of May 14, 1979, approved the scenic corridor
boundaries, declared its intention to enforce and maintain a corridor
protection program for those portions of the corridor within the
unincorporated area of the County, and requested the State Director
of Transportation to designate the route as an "Official State Scenic
Highway;"
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Saratoga as follows:
1. The City Council approves the boundaries of the corridor
survey map dated 1975, attached hereto and marked Exhibit "A". The
City Council finds that the Scenic Corridor boundaries are designed
to protect the area immediately adjacent to State Highway 9 and
inclusion of the additional noncontiguous area is designed to protect
the view from this road of the wooded slopes and streams and includes
an area to the ridges to prevent large-scale building skyline intru-
sions or grading operations which would alter the natural line of the
visible ridge line.
2. The City Council declares its intention to enforce and
maintain a corridor protection program for those portions of the
corridor now within its jurisdiction and those portions which may
come within its jurisdiction in the future. This corridor protection
program presently includes the following:
a. An adopted General Plan that includes a Scenic High-
ways Element which specifies local measures for protection of scenic
roadways.
b. Additional components of the adopted General Plan
containing policies protective of the scenic appearance of the corridor
including a Conservation Element, an Open Space Element, a Housing
Element, and a Circulation Element. Policies further provide for
preservation of aesthetic and historic features.
c. Consideration of the recommendations for enhancement
of the downtown village traversed by State Highway 9 which are
contained in 1) The Final Report of the City-appointed Village Task
Force, and 2) The Saratoga Village Design Plan.
d. Zoning Ordinance controls which provide for:
1. design review of the height and placement of
structures within the corridor, and materials
and landscaping related thereto;
2. tree preservation;
3. restrictions on signage;
4. undergrounding of utilities in new development
and improvement of property;
5. special requirements for hillside development
and slope conservation, including geologic
evaluations.
e. A Grading Ordinance which regulates earth moving
operations and specifies erosion control measures.
3. The City Council further declares its intention, when
property is proposed to be developed or public improvements are to
be installed within the designated scenic corridor, that review shall
specifically consider the appearance of the development or improvement
as viewed from the roadway. The review shall also consider avoiding
the obstruction of important views or possibly opening new views.
4. The City Council agrees ~o cooperate with the State
Department of Transportation in programs for further enhancement of
the corridor.
BE IT FURTHER RESOLVED that the City Council of the City of
Saratoga hereby requests the State Director of Transportation to
approve the Congress Springs Road - Route 9 between Blaney Plaza in
the City of Saratoga and Saratoga Gap in the County of Santa Clara
as an "Official State Scenic Highway."
BE IT FURTHER RESOLVED that the Clerk of the City Council is
hereby directed to forward twenty-five certified copies of this
resolution to the District Director, District Four, California Depart-
ment of Transportation for endorsement and transmittal to the State
Director of the California Department of Transportation.
The above and foregoing resolution was passed and adopted
at a regular meeting of the City Council of the City of Saratoga
held on June 20, 1979 , by the following vote:
