HomeMy WebLinkAboutCity Council Resolution 907 RESOLUTION NO. 907 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA APPROVING THE PACIFIC GAS ~ND ELECTRIC COMPANY'S WALKWAY PERMIT CROSSING METCALF-MONTA VISTA 230 kv L/T TO INTER- CONNECT GUAVA COURT AND FREDRICKSBURG DRIVE FOR THE USE OF A BICYCLE AND PEDESTRIAN PATH WHEREAS, the City Council of the City of Saratoga finds that the Pacific Gas and Electric Company's walkway permit attached hereto as Exhibit "A" acceptable and therefore approves the terms and conditions designated in said agreement with the following modifications: 1. Paragraph 1. of terms and conditions to be changed to provide a walkway 6-foot wide by 2 inches thick pavement. 2. Paragraph 2. modified to require the 6-foot high chain link fence to be erected at such time as P.G.& E.'s adjacent property is developed. As so modified, the Mayor of this City is authorized to execute a duplicate original of said agreement on behalf of this City and deliver the same to Pacific Gas and Electric Co. May 8, 1979 Walkway Permit to City o£ Saratoga Crossing Metcalf-Monta Vista 230 kv T/L to Interconnect Guava Court and Fredricksburg Drive _(SJ PT 5601) 653 City of Saratoga 13777 Fruitvale Avenue Saratoga, California 95070 Gentlemen: Pacific Gas and Electric Company (PGandE) hereby gives you permission, subject to the terms and conditions set forth below, to use for a public walkway the portion of PGandE's fee lands shown in red and labeled "10' pedestrian way" on the composite subdivision map attached hereto marked Exhibit A and hereby made a part hereof. Terms and Conditions: 1. The walkway shall be a four foot wide by two inch thick pavement section at approximately natural grade. 2. You ~agree to install a six foot high chain link fence along each edge of the 10 foot strip and to incorporate a 12 foot gate in each fence to allow passage along PGandE's fee lands. The fences and gates to be installed hereunder shall be grounded in accordance with PGandE's Engineering Standard 020607 attached hereto and hereby made a part hereof. 3. You agree to indemnify PGandE, its officers, agents and employees against all loss, damage, expense and liability resulting from '~' injury to or death of persons, including, but not limited to, PGandE employees or your employees, or injury to property, including, but not limited to, PGandE's property or your property, arising out of or in any way connected with your exercise of this permission, including any loss, damage, expense, or liability proximately caused or contributed to by the negligence, whether active or passive, of PGandE, excepting only such injury or death as may be caused by.the sole negligence or willful misconduct of PGandE. You agree to procure and maintain in effect during the term of this permission insurance for both bodily injury liability in the limits of $500,000/$500,000 for injury to or death of one or more persons as a result of any one accident or occurrence and property damage liability in the limits of $500,000 for damage to property resulting from any one accident or occurrence. Such insurance: (1) shall guarantee your performance of the indemnity obligation under paragraph 3. above, (2) shall be endorsed to; (a) include PGandE as an additional named insured in all matters pertaining to the construction, maintenance and use.of thewalkway~ (b) contain a cross liabilityor severability of interest clause; (c) provide that notice shall be given to PGandE at least 30 days prlor to cancellation or material change in the form of such policies; and (d) nullify any clause in such insurance excluding liability assumed under this agreement. You.agree to furnish to PGandE~ prior to your entry hereunder and within not more than 30 days after execution hereof~ certificates of insurance together with copies of the endorsements required herein. PGandE shall have the right to.inspect the original policies of such insurance. 5. No tools~ machinery, equipment, apparatus, materials, supplies or any part thereof shall be erected, handled or operated within ten.feet'of any PGandE high voltage line energizedat 50,000 volts or less. With respect to conductors energized at more than- 50,000 volts no tools, machinery, equipment, apparatus, materials, supplies or any part thereof shall be erected~ handled or operated closer than the minimum clearances set out in the High Voltage -~. and Electrical Safety Orders of the California Division of Industrial Safety, which said minimum clearances are incorporated herein by reference. No transportation or transit of any tool, machinery, equipment or apparatus or the moving of any houses orbuilding shall be carried out without observing the minimum clearances set out in the High Voltage and Electrical Safety Orders of the California Division of Industrial Safety, which said minimum clearances are incorporated herein by reference. City of Saratoga -3- May 8, 1979 6. Notwithstanding anything contained herein you agree to reimburse PGandE for any damage to PGandE's facilities resulting from your use of said parcel of land. 7. Your use of PGandE lands pursuant to this permission shall at ali times be subject to the right of PGandE, without liability or obligation to you. (a) to use and maintain its existing facilities in said lands, (b) to replace, remove, alter, or reconstruct such facilities overhead or underground, (c) to install any other facilities in the lands overhead or under- ground, and (d)grant easements or enter into leases to others for any and all purposes. 8.This permission may be revoked by PGandE upon 90 days written notice. 9. Time is of the essence of the provisions hereof. Please indicate your acceptance of this permission by Signing and returning the duplicate of this letter together with a certified copy of the City Council's Resolution of Acceptance therefore. Sheets 1 and 2 show the standard grounding procedures to be folZowed for P.G.&E. Company fences. Sheet 3 is for non-P.G.&E. Company ~' fences and gates near overhead transmission lines. Sheet 4 is for wire trellises such as used i~ vineyards, etc. Sheet 5 is the list of grounding materials. ,The basis for the grounding procedures shown is normal line operating conditions. GENERAL NQTES. COMPANY FENCES ~Sheet 2) 1. Copper cable is the standard cable used for grounding all company fences. Copperweld cable should be used for grounding only ~istributio~' Substation fences· 2. Ground each corner of fence. 3. MetaZlic gates require a shunt with one ground rod. See Figure 4. 4. Non-metallic fences do not require grounding. 5, install ground rods between corners to insure adjacent ground rods are not more than 75 feet apart. 6. For grounding requirements of substation fences where all incoming and outgoing circuits are underground, refer to the General Office Engineering Department. 7. Non-Company fence located adjacen~ to Company fence shall have a minimum of 6" separation between the two fences. This does not apply ~o non-metalZic fences. 8. If a Non-Company metalZic fence must be connected to a Company customers substation fence, refer to General Office Engineering Department. 9. "Guard Fences" (such as reactor enclosures) Zocated within the property fence shall be grcunded to the station ground grid. 1U. Eight feet is the minimum distance from fence to main station ground grid or equipment connected to the station ground grid. No eZectrical connection shalZ be made between the fence and the main station ground or structures connected to the station ground grid. Refer to Sonora1 Office Engineering Department when the minimum distance cannot be maintained or when electrical connection can not be avoided. 11. Ground all gates or each half of all double gates to fence post with flexible braid. See figure 4. 12. Soldered connections or terminals shall not be used.
