HomeMy WebLinkAboutCity Council Resolution 926 -election RESOLUTION NO. 926 RESOLUTION SUBMITTING INITIATIVE MEASURE TO THE ELECTORS AT THE REGULAR MUNICIPAL ELECTION TO BE HELD APRIL 8, 1980 WHEREAS, the City Clerk received an Initiative Petition signed by not less than 15% of the voters of the City according to the County Clerk's last official report of registration to the Secretary of State, which was submitted to the City Clerk of the City of Saratoga, and certified as filed on October 17, 1979, and WHEREAS, this Council has heretofore determined mot to adoPt said measure by ordinance but to submit the same to the voters of the City pursuant to Election Code Section 4010 (b), and to submit the proposed ordinance at the next Regular Municipal Election to be held in this City on Tuesday, April 8, 1980, NOW, THEREFORE, the City Council of the City of Saratoga hereby resolves as follows: SECTION 1: All the statements in the preamble to this resolution are hereby refèrred to as findings of this body, and are incorporated herein by reference. SECTION 2: Pursuant to Election Code Section 4020 there shall be submitted to the qualified electors of this City at the Regular Municipal Election to be held on April 8, 1980, the following proposition: MEASURE (HILLSIDE SPECIFIC PLAN) Shall an ordinance requlrlng the adoption of a specific plan for development of those Ilands, some 2100 acres in the HC-RD zoned YES hillside area, urban service area, and all lother lands gaining access to Pierce Road, Igenera1ly wes, t of sa, ratoga.,.Sunnyva1e Road and north of Congress Springs Road, requiring a decrease in density and corresponding rezoning declaring a moratorium on all development 'NO pending adoption of such plans, and containing, retroactive provisions to affect all existing la., pproved but, -undeveloped bu. i1ding sites less ¡than two years old, be adopted? ~ '_"~"~""""."-"..."-"".".",,,,..,,,,...._.,...,._.,,,.,,,"..,.,-"".,..,-,-,-,_..,..." SECTION 3: The City Clerk of the City of Saratoga is hereby directed to cause a synopsis of the measure to be voted on to , be published once a week for two successive weeks in the Saratoga News, which is a newspaper of general circulation published in said City, pursuant to Elections Code Section 22835 of the State of California. SECTION 4: The City Clerk of the City of Saratoga is hereby author- ized and directed to certify to the due adoption of this resolution and to transmit a copy thereof so certified to the Board of Supervisors of Santa Clara County and to file a copy thereof so certified with the County Clerk of said County, The above and foregoing resolution was duly and regularly passed and adopted by the City Council of the City of Saratoga at a regular meeting held on the 5th day of December, 1979, by the following vote: AYES: Councilmen Kraus, Carr & Callan NOES: ABSENT: None Councilman Matteoni 1 I all ('""'I í......."....
