A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA ADOPTING CERTAIN
POLICIES AND PROCEDURES REGARDING PROCESSING
OF APPROVED TENTATIVE MAPS FOR SUBDIVISIONS
AND LAND DIVISIONS IN TEE NORTHWEST HILLSIDE
SPECIFIC PLAN AREA.
WHEREAS, on or about April 18, 1980, the Citizens of
Saratoga passed an initiative ordinance commonly known as "Measure
A," and,
WHEREAS, Section 3 of Measure A in its entirety reads as
follows:
Section 3. PREPARATION OF A SPECIFIC PLAN. The City of
Saratoga shall within one year from the
effective date of this ordinance, or as soon
thereafter as feasible, complete a comprehen-
sive review of all development issues in the
subject area and adopt a Specific Plan for the
area pursuant to California Government Code
Sections 65450-65553, incorporating the
standards set forth in Section 4 below, and
all policies and regulations required to
implement said Plan, and,
WHEREAS, on June 2, 1981, this Council passed Resolution No.
1016 which adopted a Specific Plan for the Northwest
Hillside area of the City which area is the same area as set forth
in Measure A, and
WHEREAS, as a result of the adoption of said Specific Plan
certain conflicts now exist between the said Specific Plan and the
Zoning Ordinance and other ordinances of the City, and
WHEREAS, THE City intends to immediately undertake study and
revision of said ordinances in order to bring them into conformity
with the Specific Plan, and
WHEREAS, the City Council on June 2, 1981, adopted Ordinance
No. 3E-19.. , which imposed a moritorium on develop-
ment of properties, with certain exceptions, within the Northwest
Hillside area, and
W~EREAS, within said Northwest Killside area there are
landowners who have received tentative map approval for the
development of their property subsequent to April 25, 1978, and
WHEREAS, the Council believes that it is in the best interest
of the public health, safety, and welfare to establish a policy to
further process said approved tentative maps.
NOW, THEREFORE, the City Council of the City of Saratoga does
hereby resolve that until such time as the zoning ordinance and
other affected ordinances of the City have been modified and
revised so as to be brought into conformity with the Specific
Plan adopted for the Northwest gillside area the procedures set
forth hereinafter will be followed in the Northwest Hillside area
of the City:
1. All applications for final map approval by any person who
has obtained tentative map approval for his or her property
subsequent to April 25,197.~8, will be processed through final map
approval, provided, all conditions imposed on such tentative map
have been satisfied and such person has complied with all appli-
cable ordinances of the City other than the Specific Plan for the
Northwest Hillside area.
2. Any development which receives final map approval pur-
suant to paragraph 1 above shall, nevertheless, be denied the
issuance of any and all grading permits and/or building permits
and/or any other development permits for the said subdivision
unless or until said subdivision complies with the requirements of
said Specific Plan and with all ordinances of the City including
those ordinances modified and revised in order to conform with
said Specific Plan.
3. Exempt from the operation and requirements of this

resolution are the following:
A. Any lot shown as a unit on a recorded subdivision or
land division, or any lot otherwise legally created provided it
was created prior to April 25, 1978. Any lot so exempted will not
lose its exempt status if either of the following events takes
place subsequent to April 25, 1978:
(1) A portion of the lot is exchanged for a portion of
any adjoining lot, the result of which does not decrease the
original square footage of the lot; or
(2) The lot is enlarged by the addition of land from any
adjoining parcel.
B. (1) Subdivision Tract 6528.
(2) Those parcels of real property identified as
Assessor's parcel Nos. APN36655 and APN36656 presently owned by
the Fremont Union High School District.
I hereby certify the foregoing to be a true copy of a resolu-
tion adopted by the Council of the City of Saratoga, California, at an
adjourned regular meeting thereof held on the 2nd day of
June , 1981, by the following vote of the members
thereof:
