HomeMy WebLinkAboutCity Council Resolution 1031 RESOLUTION NO. 1031 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA AMENDING THE 1974 GENERAL PLAN WHEREAS, on January 14, 1981, following a public hearing, the Planning Commission of the City of Saratoga passed Resolution GPA-81-2-a and GPA-81-2-b, recommending to the City Council that certain amendments to the 1974 General Plan for the City of Saratoga be adopted; and WHEREAS, on February 18, 1981, a public hearing was conducted by the City Council, at which time any interested person was given an opportunity to be heard concerning the proposed amend- ments to the General Plan, and said amendments were referred to the General Plan Citizen Advisory Committee for review and comment; and WHEREAS, the City Council finds that such amendments are necessary in order to maintain consistency between the 1974 General Plan and Saratoga Zoning Ordinance, as required by the Zoning Conformance Act and Government Code Section 65860; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Saratoga does hereby adopt the following amendments to the 1974 General Plan of the City of Saratoga: A. BROOKWOOD LANE - 81-2-a The Land Use Element of the 1974 General Plan is hereby amended to reclassify that certain 2.9 acre parcel at the end of Brookwood Lane and adjacent to the Northeastern boundary of Wildwood Park, commonly known as APN 503-23-38 as more particularly shown on Exhibit "B" attached hereto, from the General Plan classification of "Proposed Park" to the following: 1. The southeasterly portion of said parcel lying within the Flood way as shown on the "Flood Boundary and Floodway Map, City of Saratoga, California, Santa Clara County - Effective Date: January 17, 1979" prepared by the U. S. Department of Housing and Urban Development, Federal Insurance Administration to "Open Space Uses - 'C' Area" to be preserved (in Development). 2. The rema_~ning Northwesterly portion of said .parcel (shown in orange on Exhibit "B" ) to "Medit~n Density Residential." The City Council hereby approves the Negative Declaration pertaining to the foregoing ~t to the 1974 General Plan, based upon the findings by the City Council that: 1. The parcel in question has been designated in the General Plan as a "Proposed Park" since 1974, however, the City of Saratoga has failed' to .purchase the property. 2. The Saratoga Parks and Recreation Ccr[nission has reviewed the parcel in question and determined that it is no longer interested in utilizing such parcel for expansion of Wildwood Park, and has no available funds to do so. 3. The Amendment will bring the 1974 General Plan Land Use Element and the Saratoga Zoning Ordinance into conformity, as required by the 1974 Zoning Conformance Act. 4. The ~t will not affect the health, safety and welfare of the surrounding area. B. HINCKS ESTATE - 81-2-b The Land Use Element of the 1974 General Plan is hereby amended to reclassify frcm "Proposed Park" to "Slope Conservation" that certain 16 acre parcel Ccrrnnly known as APN 517-13-14 and APN 517-13-15, as more particularly shown on Exhibit "C" attached hereto and made a part hereof, except for a strip of land ccrprising approximately 1+ acres along the westerly boundary thereof adjacent to Hakone Park, as shown on Exhibit "C" attached hereto which shall remain designated in the Gereral Plan as "Proposed Park." The City Council hereby approves the Negative Declaration per- taining to the foregoing Amendment to the 1974 C~_neral Plan, based upon the findings by the City Council that: 1. The parcel in question has been designated in the General Plan as a "Proposed Park" since 1974, however, the City of Saratoga has failed to purchase the property. 2. The Saratoga Parks and Recreation CEnmission has reviewed the parcel in question, and determined that it is only interested in maintaining a strip of land as determined by the Director, Parks and Recreation on the western side of the property for expansion of the Hakone Garden parking lot. 3. The Amendment will bring the 1974 General Plan Land Use Element and the Saratoga Zoning Ordinance into conformity, as required by the 1974 Zoning Conformance Act. 4. That the density of the site be reviewed by the Planning Commission. 5. The Amendment will not affect the health, safety and welfare of the surrounding area.
