RESOLUTION NO. 1047
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SARATOGA APPROVING AN AMENDMENT TO THE
COVENANTS, CONDITIONS AND RESTRICTIONS FOR
TRACTS 6526 AND 6528
WHEREAS, in 1977, the tentative map approval for Tracts
6526 and 6528 included approval of certain Covenants, Conditions
and Restrictions imposed upon all lots within said tracts; and
WHEREAS, said Covenants, Conditions and Restrictions
contained wording which restricted the maximum square footage
of homes to be built upon lots within said tracts to 4,600 square
feet including the garage area; and
WHEREAS, on August 15, 1981, the City of Saratoga enacted
a new Design Review Ordinance which would permit the square footage
of said homes to exceed 4,600 square feet; and
WHEREAS, the developer of said tracts desires to allow
development within said tracts under the restrictions and procedures
contained in the new Design Review Ordinance;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of Saratoga:
1. That the Covenants, Conditions and Restrictions
previously approved by the City of Saratoga in connection with
Tracts 6526 and 6528 are hereby amended as follows:
(a) The following statement which appears on Page
12, under Section 3, "Dwelling Cost, Quality and Size",
is hereby eliminated:
"The floor area of the main structure,
exclusive of the garages, shall not be
less than 2,000 square feet, nor shall
it be more than 4,600 square feet inclu-
sive of garages."
(b) In place of the wording eliminated under
l(a) above, the following statement shall appear:

"The floor area of the main structure,
exclusive of the garages, shall not be
less than 2,000 square feet. The design
of all structures to be built upon all
lots situated within Tracts 6526 and
6528 shall be subject to the restrictions
and procedures set forth in Ordinance
No. NS-3.47, The Design Review Ordinance."

I hereby certify the foregoing to be a true, full and
correct copy of a resolution duly passed and adopted by the
City Council of the City of Saratoga, California, at a meeting
thereof held on the 2nd day of December , 1981, by the
following vote of the members thereof:
